Sp.a: "Stop geld reddingsoperatie banken in het Zilverfonds"




De sp.a wil dat de regering het geld dat ze gebruikte om de banken te redden in het Zilverfonds stopt. Bovendien willen de Vlaamse socialisten dat elke werknemer voortaan recht krijgt op een tweede pensioenpijler. Dat maakte voorzitster Caroline Gennez zondag bekend in haar nieuwjaarstoespraak.

Volgens Gennez gebruikt de regering de economische crisis als een alibi om niets te doen en wordt daardoor het sociaal model uitgehold. Ze vindt het niet kunnen dat het Zilverfonds wordt afgebouwd. "Indien wij de afgelopen 20 jaar zo onze oren laten hangen als deze regering, dan was er vandaag geen sociale bescherming meer", aldus Gennez.

Pensioenen

Volgens de sp.a zijn de pensioenen vanaf 2014 niet langer betaalbaar, maar doet de regering hier niets aan. Daarom werkt de partij aan een pensioenplan dat de problemen moet aanpakken.

Zo willen de socialisten dat alle werknemers recht krijgen op een aanvullend pensioen. Alle individuele pensioenregelingen op ondernemingsniveau moeten bovendien geïntegreerd worden in het publiek pensioenfonds. Zo kan het wettelijke pensioen versterkt worden.

Banken

De sp.a vraagt de regering ook om alle bijdragen die aan de banken werden gestort in kader van de reddingsoperatie, goed voor zo'n 21 miljard euro, in het Zilverfonds te stoppen. Dat zijn alle dividenden, premies en betalingen van de banken en de bijdrage die de financiële instellingen jaarlijks moeten ophoesten voor de begroting.




Wat ons in dit rattenbvangersverhaal vooral intrigeert is de passage en we citeren letterlijk: "Alle individuele pensioenregelingen op ondernemingsniveau moeten bovendien geïntegreerd worden in het publiek pensioenfonds. Zo kan het wettelijke pensioen versterkt worden."


Wil ons Carolien persoonlijk komen uitleggen wat dit zinnetje exact betekent want erg duidelijk is dat voor onze muizenbreintjes niet.
Betekent dit dat alle extra-wettelijke pensioentegoeden moeten overgeheveld worden naar een een staatsfonds? Dat betekent dus concreet dat alle bedrijfspensioenplannen die meestal de vorm hebben van een verzekering, genationaliseerd zullen worden of zitten we verkeerd?
We hadden eveneens graag vernomen wat voor een beest "het publiek pensioenfonds" dan wel kan zijn? Volgens ons is het Belgische pensioensysteem nu net niet gebaseerd op publieke pensioenfondsen want er zijn, buiten wat schamele miljarden in het zilverfonds, nooit reserves aangelegd voor de uitbetaling van de wettelijke pensioenen. Wij dachten dat we in België met een repartitiesysteem zaten of met andere woorden de aktieven betalen de pensioenen van de niet-aktieven wat dus inderdaad dreigt in het honderd te lopen met de vergrijzingsgolf die eraan komt.
Dus "het publiek pensioenfonds?????" Voor ons is dit een onbekend beestje...tenzij het zilverfonds bedoeld wordt. Dat zou betekenen dat alle extra-wettelijke pensioenreserves in het zilverfonds moeten gestort worden. Hoe de SP-a zoiets geks kan bedenken weten we niet. In elk geval moet de uitvinder van zulke onzin dringend psychologische hulp krijgen of tenminste een paar jaar geïnterneerd worden in een gesloten instelling.
Het is echter totaal kierewiet te bedenken dat de individuele pensioenregelingen op bedrijfsniveau de wettelijke pensioenen moeten komen versterken. Waarom zijn die extra-wettelijke juist uitgevonden? Juist omdat de wettelijke pensioenen in ons Belgistan tot de allerlaagsten in Europa behoren. Er valt moeilijk mee te overleven als je enkel daarvan moet trachten rond te komen na een leven hard werken. Als je dan nog geen eigenaar bent van je eigen woonst dan kan je het wel schudden zonder vette spaarrekening. En dan zeggen onze inlandse sossen dat daarmee het wettelijk pensioen moet versterkt worden. Dit is de sossenwereld op zijn kop en het definitief opgeven van het gevecht voor een deftig wettelijk pensioen.
Niet dat wij iets zouden hebben tegen de tweede pijler noch tegen individueel pensioensparen, noch tegen het verwerven van een eigendom, de drie pijlers naast het wettelijk stelsel maar voor iemand die zich nog een beetje sos wil noemen is het eerste stelsel, namelijk het wettelijke pensioen datgene dat er moet voor zorgen dat je je ouwe dag kan overleven zonder ergens in de goot te zitten bedelen.

Hoe ze trouwens de sollen van de bedrijfspensioenplannen willen overhevelen daar zullen ze bij de verzekeringen toch graag wat meer uitleg over krijgen. Als je nu al ziet dat de privéziekteverzekeraars nu al hun broek vegen aan wettelijke bepalingen die hen verbieden hun premies drastisch te verhogen maar dat ze een soort index van de ziekenhuisprijzen moeten volgen en dat dus lekker niet doen dan moeten de sossen eens duidelijk maken hoe ze dat verzekeringsgels van de extra-wettelijke pensioenen in handen willen krijgen.

Meestal bestaan deze extra-wettelijke pensioenen trouwens uit twee gescheiden gedeelten, het patronale (meestal het grootste deel) en het werknemersgedeelte en bestaan er wel meer dan één systeem met meestal een totaal andere uitkomst. Je hebt rentesystemen en kapitaaluitkeringen. Je hebt systemen met een te bereiken doel en doodsimpele gekapitaliseerde fondsen met wettelijk rendement....zal dat fameuse onbekende staatsfonds al die verschillende systemen dan zelf beheren of enkel de sollen opstrijken???? Wij houden ons hart vast. In elk geval wachten we vol ongeduld op een concrete uitwerking van dit idiote plan. Maar Gennez is dan toch maar mooi in de pers gekomen en niet iedereen kan daarvoor op een Belgische vlag trappen in het bijzijn van Miss Belgique. Maar iemand zou Gennez toch eens moeten uitleggen dat je best geen botten draagt onder een snoezig zomerkleedje...Van Brempt weet dat nochtans. Dit niveau van discussies kan de SP-a nog aan, denken we. Over de pensioenen, ooit hun "core-business" zijn ze uitgepraat. Dat is duidelijk.

Colombia's attorney general has now opened a similar case, and has requested information from the Justice Department. Colombia might also seek the extradition of eight Chiquita officials on charges that the company used one of its own ships to smuggle weapons to the same paramilitary group.

The news about links between bananas and terror comes amid continuing revelations about the depth and breadth of paramilitary influence at all levels of government. "Para-politics" has already taken down the country's foreign minister, a provincial governor and the head of the secret police, among others.

Now the mounting scandal is closing in on one of President Álvaro Uribe's closest allies. Just last weekend, the Los Angeles Times revealed a secret intelligence report that has been circulating recently at the CIA charging that the head of Colombia's Army, Gen. Mario Montoya, planned and executed a 2002 military operation with Medellín-based paramilitaries. Army forces killed at least fourteen people during "Operation Orion," with dozens more reportedly disappeared during the sweep.

Many wonder whether the crisis will be the undoing of President Uribe himself, who is considered Washington's top ally in Latin America.

These recent disclosures and a growing collection of declassified documents are beginning to provide a clearer picture not only of how business is done in Colombia but also of the nexus of paramilitary-corporate-state terror that fuels Colombia's conflict.

Good Faith?

The indictment handed down by US Attorneys in the Chiquita case describes in the most lucid terms the deliberate, methodical nature of the company's relationship with the paramilitaries.

Chiquita's payments to paras began in 1997, the year the AUC was formed, and continued until February 2004. Importantly, the company gave the group at least $825,000 after it was designated a Foreign Terrorist Organization (FTO) in 2001. US law bars support to any organization on the State Department's FTO list.

Chiquita had been making similar payments to the leftist FARC and ELN guerrillas since returning to Urabá in 1989. Seven years earlier, the company had sold off its holdings in the war-torn region, but was lured back by the promise of expanding international fruit markets.

It is not immediately clear what weighed into Chiquita's decision to switch from the guerrillas to the paras in 1997. One factor may have actually been the law. That year, both the FARC and ELN were added to the FTO list. The AUC was not added until 2001. But it was also clear that the paras had gained the upper hand in Urabá, the country's top banana-growing region, and the center of Chiquita's Colombia operations.

The payments were arranged by Carlos Castaño, the AUC's fugitive (now deceased) leader, in a 1997 meeting with officials from Banadex, a wholly-owned Colombian subsidiary of Chiquita. Castaño and other paramilitary chiefs formed the AUC that same year, coordinating the military and political strategies of previously disparate paramilitary groups.

The indictment suggests that the paramilitary chief used a combination of coercion and enticement. "Castaño sent an unspoken but clear message that failure to make the payments could result in physical harm" to the company and its personnel. On the other hand, he also assured Banadex "that the AUC was about to drive the FARC out of Urabá."

Castaño delivered on his promise. The first payment came just in time to help underwrite a major southward expansion of paramilitary influence in the country. Over the next seven years, Chiquita would make more than 100 separate payments to the AUC, and the AUC would carry out some of its most shocking massacres.

The paramilitary offensive began with the July 1997 killings of at least thirty civilians in Mapiripán, a traditionally guerrilla-controlled hamlet in a remote coca-growing region in southeastern Colombia. Some 200 AUC paramilitaries were flown in from Urabá to carry out the slaughter, their entrance and exit facilitated by local army troops.

Paramilitary killings rose dramatically while the payments continued. The AUC quickly gained a reputation for the shocking brutality of its crimes, and Castaño openly boasted about many of them. The slaughter left a trail of mangled corpses across the country, from the banana farms of Urabá to the coca fields of Putumayo. An overwhelming majority of the victims were civilians.

The indictment states that the payments "were reviewed and approved by senior executives of the corporation," who knew by no later than September 2000 "that the AUC was a violent, paramilitary organization led by Carlos Castaño.

Chiquita insists that it was simply trying to do the right thing. "The payments made by the company were always motivated by our good faith concern for the safety of our employees," Chiquita CEO Fernando Aguirre said in a statement published March 22 in the Chicago Tribune.

The "good faith" payments continued for more than a year even after the company disclosed the relationship to the Justice Department in 2003. At that time, Chiquita's lawyers insisted that the company terminate the arrangement. "Must stop payments," said one note obtained by prosecutors. "You voluntarily put yourself in this position," read another. "Duress defense can wear out through repetition. Buz [business] decision to stay in harm's way. Chiquita should leave Colombia."

Astoundingly, Chiquita made at least nineteen more payments even after the Justice Department told the company that "payments to the AUC were illegal and could not continue."

Mario Iguarán, Colombia's attorney general, says he will seek the extradition of eight Chiquita officials connected to the case. His office is also seeking information about charges that in 2001 a ship unloaded some 3,400 AK-47 rifles and 4 million rounds of ammunition in a Banadex-controlled dock in Colombia destined for the AUC. These charges were first detailed in a 2003 report from the Organization of the American States.

"This was a criminal relationship," said Iguarán, in a recent report published in theWashington Post. "Money and arms and, in exchange, the bloody pacification of Urabá."

The Convivir Connection

The Chiquita indictment also implicates the Colombian state through a program known as Convivir, a network of hundreds of private security cooperatives licensed by the government to patrol rural areas and gather intelligence under the direction of local military commanders.

The Convivir connection is particularly resonant now. President Álvaro Uribe was one of the program's key sponsors while governor of that region in the mid-1990s. As president, he has established similar intelligence and security networks around the country.

The indictment lists dozens of AUC payments that were channeled through "intermediaries" from "various" Convivir groups in Urabá. The AUC used these groups "as fronts to collect money from businesses for use to support its illegal activities."

The fact that the company was obliged to channel its illegal payments through the ledgers of the state-backed security network is especially telling. Clearly the AUC did not expect any interference, and in the end, the Convivir appear to have functioned much as US intelligence predicted they would.

From the start, US military officials had said that the program would "degenerate into uncontrolled paramilitary groups." Ambassador Myles Frechette wrote in 1994 that there had "never been an example in Colombia of a para-statal security group that has not ultimately operated with wanton disregard for human rights or been corrupted by local economic interests."

One Colombian Army colonel told the Embassy in 1997 that there were "serious problems with the legal 'Convivir' movement," and acknowledged the "potential for the convivir's to devolve into full-fledged paramilitaries."

Indeed, the Convivir were linked to the most brutal massacres of the AUC offensive. The president of one Urabá-based Convivir was found at the scene of a 1998 massacre of fourteen peasants near the Colombian capital. One Colombian expert told the US Embassy that, like Mapiripán, these killings "sent a message to the FARC that the paramilitaries can go anywhere and do anything. Not long thereafter, the president of one Urabá-based Convivir was found dead at the scene.

Above all, it was clear that the military was neither prepared nor inclined to challenge Castaño. In 1998 the CIA reported that senior Colombian military officers were "frustrated with the military's dismal performance on the battlefield" and might "increasingly view turning a blind eye--and perhaps even offering tacit support to--the paramilitaries as their best option for striking back at the guerrillas."

Then-Armed Forces Commander Manuel Bonett, like his predecessor, Harold Bedoya, had demonstrated "little inclination to combat paramilitary groups," according to another CIA report.

The information obtained by the Times last week suggests that the CIA also has serious doubts about whether Colombia's current army commander has the resolve to sever paramilitary ties. The allegations link General Montoya to Diego Murillo, the former leader of a vicious paramilitary group based in Medellín. Murillo currently sits in a Colombian jail, while the government mulls his extradition to the United States on drug charges.

The Cost of Doing Business

"Funding a terrorist organization can never be treated as a cost of doing business," said US Attorney Jeffrey Taylor in a press release about the Chiquita case. But while the Justice Department deserves some credit for pursuing the company's ties to the paras, the result is unlikely to have much impact on the way business is done in Colombia.

With last week's plea, Chiquita has received an even better deal than the AUC is getting under President Uribe's "Justice and Peace" program.

Critics deride "Justice and Peace" as an "amnesty" scheme designed specifically for Colombia's paramilitary armies. The plan calls on the AUC to disarm and demobilize its forces in return for dramatically reduced criminal penalties. Paramilitary leaders who agree to make full confessions and nominal reparations payments to the thousands of victims of the group's ghastly reign of terror are guaranteed light sentences under the program.

But despite the new evidence, the process is unlikely to uncover much about Montoya's paramilitary sympathies, or the military's Convivir networks. The government commission established to adjudicate the truth and reparations process is not specifically authorized to investigate the Colombian state, only "illegal armed groups."

It does seem likely that the CIA disclosure will strain relations with the Colombian military. As head of the Colombian army, General Montoya wields tremendous influence, and the United States needs his support for its counternarcotics programs and other priorities. Montoya's fate may be more closely tied to decisions made by a Democrat-controlled US Congress than by the Colombian justice system.

The Chiquita case provides one additional twist. Lauded in recent years for the unprecedented number of narco-trafficking suspects it has handed over to the United States, the Colombian government has now turned the extradition issue on its head, putting the US government in the delicate position of responding to Colombia's request for the extradition of Chiquita executives. This case will surely be one to watch, as the Colombian government relishes its chance to divert attention away from its own paramilitary problem.

But if history is any guide, the Chiquita execs have little to fear. Impunity is far more frequently the rule than the exception in Colombia. And for the time being at least, coming to some sort of modus vivendi with paramilitaries is likely to remain the "cost of doing business" in Colombia.

For American corporations, the rewards of doing business abroad are enormous, but so are the risks. And over the past 25 years no place has been more perilous than Colombia, a country that is just beginning to emerge from the throes of civil war and narco-terrorism.

Chiquita Brands International of Cincinnati, Ohio, found out the hard way. It made millions growing bananas there, only to emerge with its reputation splattered in blood after acknowledging it had paid nearly $2 million in protection money to a murderous paramilitary group that has killed or massacred thousands of people.

As correspondent Steve Kroft reported last year, the victims' families are now suing Chiquita in an American court, and investigators in Bogota and on Capitol Hill are looking at other U.S. companies that may have done the same thing.



From the air, the plains of the Uraba region are carpeted with lush foliage of banana plantations, which have long provided a livelihood for the people of northern Colombia. And for the better part of century, its best known product has been the Chiquita banana.

But since the 1980's, the business of bananas there has been punctuated with gunfire. First, the area was taken over by Marxist guerillas called the "FARC," whose ruthlessness at killing and kidnapping was exceeded only by the private paramilitary army that rose up to fight them. Chiquita found itself trying to grow bananas in the middle of a war, in which the Colombian government and its army were of no help.

"These lands were lands where there was no law. It was impossible for the government to protect employees," says Fernando Aguirre, who became Chiquita's CEO long after all this happened.

Aguirre says the company was forced to pay taxes to the guerillas when they controlled the territory in the late 1980s and early 90s. When the paramilitaries, known as the "AUC," moved in in 1997 they demanded the same thing.

"Did the paramilitaries state, specifically to you, that if you didn't make the payments, your people would be killed?" Kroft asks.

"There was a very, very strong signal that if the company would not make payments, that things would happen. And since they had already killed at least 50 people, employees of the company, it was clear to everyone there that these guys meant business," Aguirre says.

Chiquita only had a couple of options and none of them were particularly good. It could refuse to pay the paramilitaries and run the risk that its employees could be killed or kidnapped, it could pack up and leave the country all together and abandon its most profitable enterprise, or it could stay and pay protection, and in the process, help finance the atrocities that were being committed all across the countryside.

"These were extortion payments," Aguirre says. “Either you pay or your people get killed.”

"And you decided to pay," Kroft remarks.

"And the company decided to pay, absolutely," Aguirre says.

There was no doubt in the company's mind that the paramilitaries were very bad people, Aguirre says.

Just how bad was already becoming evident. The paramilitaries, who were funded initially by large landowners, and later by the cocaine trade, not only drove the Marxist guerillas from the area, they tried to eliminate anyone who might have leftist sympathies, from labor leaders to school teachers. Sometimes entire villages were wiped out in the most grisly fashion. Gloria Cuartes was the mayor of Apartado, and witnessed much of it with her own eyes.

"I was a mayor whose job was just to gather the dead," Cuartes says.

In 1996 she went to a school to talk to the children about the violence that surrounded them. While she was there, the paramilitaries arrived and murdered a 12-year-old boy, whose only crime had been to announce their presence.

"They cut off his head, and they threw the head at us," Cuartes remembers. "I went into a state of panic. They were there for four hours, with their weapons, firing shots toward the ceiling. One hundred girls and boys were with me. The children did not scream. They were in shock."

Asked if they said anything to her, Cuartes says, "No. Their language was death. Their message was that if they could do this to children, they could do it to me."

As the atrocities piled up all across the country, Chiquita continued to make the payments to the paramilitaries, viewing itself as a victim of the violence, not a facilitator.


But all of that changed in 2001, when the U.S. government designated the paramilitaries a terrorist organization, making any kind of financial assistance to the group, coerced or otherwise, a felony. Yet Chiquita continued to make the payments for another two years, claiming it missed the government's announcement.

"It was in the newspapers. It was in the Cincinnati Enquirer, which is where your company headquarters is. It was in the New York Times," Kroft points out. "I mean, this is a big part of your business, doing business in Colombia. I mean, how did you miss it?"

"Well, again, I don't know what happened during that time frame, frankly. What I know is, all the data shows that the company, the moment it learned that these payments were illegal in the United States, that's when they decided to self-disclose to the Department of Justice," Aguirre says.

By "self-disclose," he means Chiquita, on the advice of its attorneys, turned itself in to the Justice Department. One of the first things Aguirre did when he became CEO was to stop the payments and sell the company's Colombian subsidiary. The company pled guilty to a felony and agreed to pay a $25 million fine, but that wasn't the end of its legal problems.

"This company has blood on its hands," says attorney Terry Collingsworth, who has filed one of five lawsuits that have been brought against Chiquita, seeking money for the families of Colombians killed by the paramilitaries.

Collingsworth says the money Chiquita paid for seven years may have kept its employees safe, but it also helped buy weapons and ammunition that were killing other people.

"Are you saying that Chiquita was complicit in these massacres that took place down there?" Kroft asks.

"Absolutely. If you provide knowing substantial assistance to someone who then goes out and kills someone, or terrorizes, or tortures someone, you're also guilty," Collingsworth says.

Asked if he believes that Chiquita knew this money was being used to go into the villages and massacre people, Collingsworth says, "If they didn't, they would be the only ones in the whole country of Colombia who didn't think that."

"You're not saying that Chiquita wanted these people to be killed?" Kroft asks.

"No, they were indifferent to it," Collingsworth says. "…they were willing to accept that those people would be dead, in order to keep their banana operation running profitably, and making all the money that they did in Colombia."

Collingsworth says he thinks the company should have just picked up and left.

"It's easy for a lawyer to give that type of advice, after the fact," Aguirre argues. "When you have more than 3,500 workers, their lives depend on you. When you've been making payments to save their lives, you just can't pick up and go."

"What did the company think this money was gonna be used for?" Kroft asks.

"Well, clearly to save lives," Aguirre says.

"The lives of your employees?" Kroft asks.

"Absolutely," Aguirre says.

"It was also being used to kill other people," Kroft says.

"Well, these groups were funded with hundreds of millions of dollars. They had the guns," Aguirre says. "They had the bullets. So I don't know who in their right mind would say, 'Well, if Chiquita would have stopped, these killers would have stopped.' I just don't see that happening."

"Do you feel that the company has any responsibility to compensate the victims of the paramilitaries in Colombia?" Kroft asks.

"The responsibility of any murders are the responsibility of the people that made the killings, of the people who pulled the trigger," Aguirre says.


The Justice Department decided not to prosecute any corporate officers at Chiquita, which included prominent businessmen such as former CEO Cyrus Freidheim Jr., who later led the Sun-Times Media Group, and board member Roderick Hills, a former chairman of the Securities and Exchange Commission.

The decision created a furor in Colombia. The country's prosecutor general said he would begin his own investigation, and has threatened to extradite some of Chiquita’s executives to stand trial in Colombia.

There's also a Congressional investigation, led by Representative William Delahunt of Massachusetts, who chairs a House Foreign Affairs subcommittee.

Rep. Delahunt has been quoted as saying that Chiquita is the tip of the iceberg.

Asked what he means by that, Delahunt tells Kroft, "Well, I think that there are other American companies that have conducted themselves the same way that Chiquita has, except they haven't been caught."

How many companies?

"Well, there are several," Delahunt says.

Delahunt says he doesn't want to share more information "because I want to give those companies an opportunity to come before the committee."

60 Minutes did find one person who was willing to name names inside a maximum security prison outside Medellin: Salvatore Mancuso was once the leader of the paramilitaries.

"Chiquita says the reason they paid the money was because your people would kill them if they didn't. Is that true?" Kroft asks.

"No it is not true," Mancuso says. "They paid taxes because we were like a state in the area, and because we were providing them with protection which enabled them to continue making investments and a financial profit."

"What would have happened to Chiquita and its employees if they had not paid you?" Kroft asks.

"The truth is, we never thought about what would happen because they did so willingly," Mancuso says.

Asked if the company had a choice, Mancuso says, "Yes, they had a choice. They could go to the local police or army for protection from the guerillas, but the army and police at that time were barely able to protect themselves."

Mancuso helped negotiate a deal with the Colombian government that allowed more than 30,000 paramilitaries to give up their arms and demobilize in return for reduced prison sentences. As part of the deal, the paramilitaries must truthfully confess to all crimes, or face much harsher penalties.

"Was Chiquita the only American company that paid you?" Kroft asks Mancuso.

"All companies in the banana region paid. For instance, there was Dole and Del Monte, which I believe are U.S. companies," Mancuso claims.

Both Dole Food Company and Fresh Del Monte Produce, which is not affiliated with Del Monte Foods, have issued statements strongly denying that they made payments to the paramilitaries. Fresh Del Monte Produce said its Colombian operation is "limited to a sales office which purchases bananas from independent growers."

"Dole and Del Monte say they never paid you any money," Kroft tells Mancuso.

"Chiquita has been honest by acknowledging the reality of the conflict and the payments that it made; the others also made payments, not only international companies, but also the national companies in the region," Mancuso says.

"So you're saying Dole and Del Monte are lying?" Kroft asks.

"I'm saying they all paid," Mancuso says.

Mancuso has been indicted in the U.S. for smuggling 17 tons of cocaine into the country. He said he was more than willing to tell U.S prosecutors anything they want to know.

"Has anyone come down here from the United States to talk to you about Dole, or to talk to you about Del Monte or any other companies?" Kroft asks.

"No one has come from the Department of Justice of the United States to talk to us," Mancuso says. "I am taking the opportunity to invite the Department of State and the Department of Justice, so that they can come and so I can tell them all that they want to know from us."

"And you would name names?" Kroft asks.

"Certainly, I would do so," Mancuso says.

So far, the only company that has been charged with paying money to terrorists in Colombia is the one that turned itself in.

"Do you think if you hadn't gone to the Justice Department and disclosed the situation, that anything would've happened to you?" Kroft asks.

"Well, Mr. Kroft, if we hadn't gone to the Justice Department, we probably would not be here talking about this whole issue. No one would know about this," Aguirre says.



Since our story aired, Salvatore Mancuso has been extradited to the U.S. to face drug charges, and the Colombian government has stepped up its investigation of Dole. Two jailed paramilitary leaders have corroborated Mancuso's claims that they received protection money from the company.

Chiquita Brands seeks dismissal paramilitary trial

Chiquita Brands International asked a judge Friday to dismiss lawsuits claiming the banana company paid Colombian paramilitary groups that killed hundreds or even thousands of people.

Lawyers for Chiquita insisted that the money it paid over a seven-year period to the United Self-Defense Forces of Colombia had no direct connection to massacres, kidnappings, assassinations and acts of intimidation committed by the group in banana-growing regions.

"There are no allegations that Chiquita was directly involved in any of these incidents," said Gregg Levy, an attorney for Cincinnati-based Chiquita.

The company acknowledges a subsidiary had paid the right-wing paramilitary group — known by its Spanish acronym AUC — and another group. But its lawyers contend the company was essentially extorted by the groups that controlled areas where its bananas are grown.

But lawyers for the Colombian plaintiffs claim in the lawsuits that Chiquita should be held liable for billions of dollars in wrongful death damages, alleging it paid both the AUC and the left-wing Revolutionary Armed Forces of Colombia, or FARC. The U.S. lists both as terrorist groups.

"The AUC was engaging in murder, torture, forced disappearances and destruction of these communities," said Terry Collingsworth, representing family members of about 173 people who died. "Everybody knew this. Chiquita knew it."

The lawsuits claim Chiquita should be held liable for allegedly providing material support to the AUC in the form of cash, weapons such as AK-47s, military supplies and even access to its banana ports for cocaine trafficking.

In return, lawyers for the hundreds of Colombian plaintiffs claim, the AUC used violence to drive out or kill Colombian labor leaders, attack rival left-wing FARC guerrillas and their sympathizers, and essentially become rulers of a region encompassing some 200 Chiquita banana farms.

The lawsuits were filed around the country and consolidated in West Palm Beach before U.S. District Judge Kenneth A. Marra, who held a hearing Friday on the company's motions to dismiss.

Marra is expected to issue a written ruling later in cases that collectively could amount to the largest wrongful death claims in U.S. history, according to attorneys involved. There was no timetable for Marra to rule.

One claim on behalf of more than 600 people identified only as "Juan Does and Juana Does" is seeking $20 million for each plaintiff, or more than $13 billion. Another lawsuit seeks class-action status, which could amount to tens of thousands of plaintiffs and possibly higher damage amounts if successful.

Collingsworth said the AUC's actions pacified the region, claiming that improved Chiquita's profits from Colombia and forced out any smaller competitors.

Chiquita, he said, "knew their support was accomplishing these objectives," he said.

The lawsuits were filed after Chiquita previously acknowledged making payments to the AUC. The company paid a $25 million fine.

But Chiquita denies responsibility for killings by the Colombian groups. Through its Banadex subsidiary, Chiquita said it paid about $1.7 million from 1997 to 2004 to the AUC.

Chiquita, which sold Banadex in 2004, contends that it was forced to pay both the AUC and FARC as a form of extortion and that the company had no control over violent acts by those groups. The two paramilitary groups have fought for decades in Colombia's bloody civil war, and Levy questioned whether the AUC was engaged in "terrorism" in the legal sense.

"There is considerable dispute among the nations of the world about terrorism. There are disputes about the definition of terrorism," Levy said.

The lawsuits were brought under the Alien Tort Statute, adopted in 1789 in part to deal with piracy claims. It allows non-U.S. citizens to make claims in U.S. courts for acts that violate international law.

Chiquita Lauded for Human Rights Abuses

In its most recent edition, the magazine, “Super Lawyers,” gave its cover story to the General Counsel of Chiquita Brands International, praising him for navigating the complex and difficult waters of Colombia. What it failed to mention is the trail of tears in Latin America left behind by Chiquita (formerly United Fruit, the architect of the 1954 coup in Guatemala as well as the 1928 massacre of striking banana workers in Cienaga, Colombia memorialized in One Hundred Years of Solitude). The following letter, by union labor lawyer, Dan Kovalik highlights the contradictions in the applause given to Chiquita. We note that, just after this letter was written, Chiquita also received (quite ironically) a “sustainability award” for its business abroad.


Re: Super Criminals

Dear Mr. White,

I just had the unfortunate experience of reading the cover story of your recent publication, "Super Lawyers," which lauded the atrocities of Chiquita (formerly, United Fruit) -- a company with a laundry list of atrocities to its name, to be sure.

Your publication, which purports to highlight "not just the 'Usual Suspects,'" actually did focus on one of the "Usual Suspects" for war crimes in this issue. In this particular issue, you chose to applaud the General Counsel of Chiquita for what he claimed to be Chiquita's "extra-difficult decisions to save lives" by paying murderous paramilitaries over $1.7 million over a 7-year period. Nothing is said of the lives lost due to these payments, nor is there mention of the cache of arms provided to the paramilitaries by Chiquita's Colombian subsidiary (another count Chiquita pled guilty to).

According to Colombia's Attorney General, Mario Iguaran, Chiquita's payments to the paramilitaries were "not paid for protection, but rather, for blood; for the pacification of the Uruba banana region." Iguaran, hardly a liberal, having been appointed by President Alvaro Uribe, estimates that around 4,000 civilians were killed as a result of the assistance Chiquita gave to the paramilitaries. Moreover, Iguaran has opined that the very phenomenon of parmilitarism which has gripped Colombia for years and which has led to countless murders, rapes and other atrocities, would not have been possible without this assistance by companies like Chiquita.

Yet, notwithstanding these facts, you chose to give Chiquita's General Counsel your cover story to spew his apologies for his company's support for war crimes. Of course, I should not be surprised, the law, after all, being an instrument created and maintained to protect the rich and strong from the poor and oppressed. I might just suggest that, to keep up the facade of a justice system blind to the pocketbook of the parties coming before it, you might not want to be so obvious in your publication in highlighting the legal profession as a guardian of those who amass profit through acts of massive violence.

I guess Bob Dylan said it best when he wrote, "All the criminals in their suits and their ties, are free to drink martinis and watch the sun rise . . . ."

I could end my note here, but a bit more is worth saying. Thus, even if we take Chiquita and Mr. Thompson at their word, their conduct hardly warrants congratulations. First, even by their own admissions to the Justice Department and to your magazine, it allegedly took them over 2 years to realize that the paramilitaries they were paying and providing arms to were designated by the U.S. State Department as "terrorists." Is this a mark of great lawyering? Most of us would be fired for taking so long to realize our client was engaged in such a high crime. Indeed, what you call "super lawyering" would simply be called "malpractice" by most reasonable observers. And, even if they were paying "protection" to these killers to grow and profit from bananas as they claim, is that also a reason for praise? The Justice Department, which certainly let these folks off quite easily (they should all be in jail), certainly didn't think this excused them from punishment.

I will end this by asking that you please refrain from ever sending me your publication again. You should be ashamed of yourself and your magazine. But, of course, we live in a world largely without shame, where petty criminals spend years in jail and the big criminals rule the world, thanks to the law you claim to be so dedicated to.

The big three that need to forgive Haiti's debt

Today, the Paris Club -- an informal group of finance officials from the 19 richest nations, who push for low-income country debt restructuring and relief -- officially called for the cancellation of Haiti's debt.

Earthquake aside, such a prominent call for debt relief for the Caribbean nation is overdue. Haiti is a very poor country. It is also a very indebted one, part of a legacy extending back to the 1820s. Then, France required the former slave colony to pay something like $20 billion in today's dollars for its freedom. The country has struggled ever since, with former dictator Jean-Claude Duvalier raiding the country's accounts and amplifying what it owes.

The debt hurts Haiti, horribly. As of last year, Haiti was paying $50 million a year just to service its debt, not even to pay down the principal. It owed hundreds of millions -- more than a quarter of its GDP.

Last summer, two groups moved to cancel Haiti's debts given improved governance and economic growth under President Rene Preval. In June, an International Monetary Fund program, the Highly Indebted Poor Countries (HIPC) initiative, announced the forgiveness of $1.2 billion of Haiti's $1.9 billion in debt. A month later, the Paris Club followed suit, cancelling $214 million further, with Canada, Belgium, Denmark, France, Germany, Italy, the Netherlands, Spain, Britain, and the United States forgiving what Haiti owed them.

That still left the country -- which has a GDP per capita of around $1,300, the same as Bangladesh -- more than $700 million in the red. Experts have estimated that the earthquake -- which killed an estimated 50,000 and leveled the population, government, and business center of Port-au-Prince -- has wiped away at least 15 percent of Haiti's GDP.

France, under Finance Minister Christine Lagarde, who heads the Paris Club, has led the push for other governments and entities to make Haiti debt-free. This means speeding up the cancellation of Haiti's debts, a process which can take years even when countries and banks have committed to clearing the books. More importantly, it means convincing Haiti's main creditors -- the Inter-American Development Bank (IADB) and the governments of Taiwan and Venezuela -- to forgive it.

Haiti owes Venezuela around $167 million and Taiwan $91 million. Ma Ying-jeou, the president of Taiwan, today signaled that the country will forgive the debt. "I have already asked the foreign ministry to conduct the necessary reviews to help Haiti to pass through this difficult time," he said. Thus far, President Hugo Chavez has not addressed the question.

The IADB forgave $511 million in debt last year, still leaving Haiti owing it more than $440 million. The bank this week approved $128 million in grants -- and the board of governors is convening to discuss further debt cancellations.

Politie schiet overvaller neer in Laken

LAKEN - Bij een overval op een Lidl-warenhuis in de Brusselse gemeente Sint-Jans-Molenbeek is het donderdagnamiddag tot een schietpartij gekomen tussen een overvaller en de politie. Dat meldt het Brusselse parket. De overvaller is daarbij om het leven gekomen.

Rond 15.30 uur heeft een man een Lidl-warenhuis in de Rotterdamstraat in Sint-Jans-Molenbeek overvallen. Na de overval ging de dader er op de fiets vandoor maar hij stootte op een politiepatrouille die de achtervolging inzette. De dader begon in het wilde weg te schieten.

In de Drootbeekstraat in Laken reden de agenten het achterwiel van de vluchter aan zodat die ten val kwam. De man zette zijn vlucht te voet verder en vuurde daarbij opnieuw op de agenten in de buurt van een schooltje. Een Turkse vrouw die haar kind kwam ophalen is daarbij gewond geraakt aan haar heup. Ook een politieagent raakte ernstig gewond. De slachtoffers verkeren volgens de politie niet in levensgevaar.

Uiteindelijk vuurde een agent een dodelijke kogel af op de dader. Over zijn identiteit zijn nog geen details bekend. Waarschijnlijk was er nog een tweede overvaller, maar die is voorlopig spoorloos.



En wij willen dus het enige blog worden dat geen artikel over Haïti schrijft. Basta! En over Opel?
Daar willen we gewoon een vraag stellen. Weet iemand nog wie de echte nieuwe bazen zijn van GM? Anders gezegd de grootste aandeelhouders van New GM? Want het oude GM heet tegenwoordig doodgewoon de Motor Liquidation Company...zegt waarschijnlijk genoeg.

Toyota threatens 50,000 California jobs

For 25 years, NUMMI workers have made award-winning, high-quality cars and pickup trucks for Toyota. While the economic crisis has affected the auto industry worldwide, Toyota has never closed a factory or laid off a single full-time worker in Japan. Toyota apparently feels American workers are more expendable.

The closure of NUMMI will have a devastating impact on California’s already ailing economy and on every California family. At stake are the jobs of 4,500 auto workers and 50,000 supplier and support workers at more than 1,000 businesses throughout the state. Job losses of this magnitude will have a crippling effect on small businesses in many communities and drastically reduce tax revenue needed for roads, parks, schools, and other public services.

California is by far Toyota’s single biggest market for automobile sales in the United States. Californians, and in fact all Americans, have supported Toyota not only as consumers but also as taxpayers, financing the recent federal "cash for clunkers" program which benefited Toyota more than any other auto company. And now, Toyota has launched a $1 billion marketing campaign to increase sales in California and the United States -- at the same time they are shipping our jobs away!

In elk geval is de armen laten zakken evenmin een oplossing. Maar dit is toch nog maar eens een mooi voorbeeld hoe ons huidige economische systeem rare bokkensprongen maakt...Wij volgen effe niet meer...Wat was weer de juiste definitie van het woordje "protectionisme"?

Nu we nog eens mochten vernemen van LDD hoe we de staat moeten ontvetten en zo veel mogelijk alles overlaten aan de privé is het toch misschien interessant om naar Amerika te kijken. Daar is privatisering al jaren het toverwoord en LDD verwijst graag naar ginder als lichtend voorbeeld voor ons eigen Vlaanderen:

When the entertainers of the right aren't declaring their disgust with President Obama for groveling before foreign potentates, they're pretending to fear him as a left-wing thug, an exemplar of what they call "the Chicago way." As imagined by the right, the men in the West Wing are like a demonic cross between the antiwar demonstrators who gathered in Grant Park in 1968 and the Chicago cops who cracked their hippie skulls. Tremble, men of commerce, before this infernal combination.

Myths like this are fun to invent. The problem, as ever, is reality.

Consider one of the actual news stories to emerge from Chicago of late: The city's decision to privatize its parking meters. Thanks to a deal finalized in 2008, Chicago's parking meters will be operated for the next 75 years by a group of investors put together by Morgan Stanley, including the sovereign wealth fund of Abu Dhabi.

As it happens, Chicago is the nation's leader in municipal privatization efforts. That's right: The city that conservatives portray as the citadel of the power-grabbing, government-growing left has been selling itself off in pieces for years. It signed a 99-year lease for the Chicago Skyway, a toll road in the city's South Side, back in 2005. It did the same for its big downtown parking garages in 2006. Last year, it approved a deal to privatize Midway Airport; fortunately, the arrangements fell through.

The city's longtime mayor, Richard M. Daley, is such a keen enthusiast of privatization that he has promoted it as the budget solution for every government in the land. "If they start leasing public assets—every city, every county, every state and the federal government—you would not have to raise any taxes whatsoever," Mr. Daley told the Chicago Sun-Times in January. "You would have more infrastructure money that way than any other way in the nation."

Selling public property is the true Chicago way. Had Mr. Obama not been elected president, the nation's business journals would be falling over one another to praise his city for its daring, market-friendly innovations.

And if they chose, they would also find just as much to criticize in Mayor Daley's real-life privatization spree as they do in the brutality that they imagine President Obama shows his opponents.

The details of the parking meter deal, for example, were negotiated by the Daley administration with almost no public scrutiny. When it came time to approve the billion-dollar arrangement, the city council got exactly two days. It was a farce. According to a report issued by Chicago's inspector general, "No financial analysis was provided of the value of the parking-meter system to the City if it retained the system, since no such analysis had been done. . . . There was no public comment; no testimony from critics or experts; no presentation of recent studies" on privatization elsewhere.

It was not until months later that Chicagoans discovered what a lousy deal it was. The inspector general's report estimates that the private investors paid a little more than half the amount that the system would have generated had the city held onto the meters itself.

One alderman, described at length in the Chicago Reader last May, figures that the parking system might be worth four times what the investors paid. "The taxpayers had been hosed," the Reader concluded.

Meanwhile, the cost of parking increased dramatically, as the new parking-meter proprietor sought to maximize its return. Meters broke down from the unaccustomed load of quarters. Tickets were handed out with abandon. Chicagoans were furious.

What they eventually learned is that they had handed over a component of self-governance to a private company that is, by definition, unconcerned with the public interest. Chicago police will still hand out parking tickets; the state of Illinois will still suspend drivers' licenses; but for the next 75 years all of it will be done to ensure that citizens render proper tribute to Wall Street.

And now comes the inevitable denouement. Last week, the Chicago City Council voted to plug a hole in its 2010 budget using funds remaining from the billion-dollar parking-meter haul, despite earlier plans to invest the money for the long term. Almost all of it will be gone by the end of next year.

It may not fit the myth, but that's the real Chicago way. Sell off public property without public scrutiny. Prohibit public input on an essential public service. Rationalize the whole thing, as Mr. Daley's administration has done, by insisting that government can't run such things as well as the private sector can.

And then, when the money runs out, privatize something else: The water supply, maybe. The sewer system. An airport or two.

Why not privatize a U.S. Senate seat, too? Just imagine what Abu Dhabi would pay for that.

Gisterenavond stelden we de vraag waar de Belgische gemeenten de centen zouden halen om de aandelen die Electrabel nog aanhoudt in Elia over te nemen. Electrabel heeft immers laten weten dat het haar aandelen in Elia te koop stelt. We weten dat de gemeenten op een hoop geld zitten door de verkoop van hun participatie in Distrigas aan het Italiaanse ENI maar die berg geld moet dienen om de Electrabelaandelen in Fluxys over te nemen. Dat was al een tijdje afgesproken en daarmee was het geld op. Dus waar zouden ze de nodige poen halen, om hun aandeel in Elia op te trekken met de 23% Electrabelaandelen????

Wel, vandaag stond het antwoord reeds te lezen in de krant. We zijn niet gewoon om zo vlug antwoord te krijgen op onze vragen maar we vermoeden dat het niet echt op onze vraag was dat er werd geantwoord. Wel op de zelfde vraag maar vanuit een andere hoek. Maar we zijn toch blij het antwoord te kunnen lezen:

Gemeenten niet zo happig op Elia

BRUSSEL - Als Electrabel zijn aandelenpakket in het hoogspanningsbedrijf Elia verkoopt, dan is het niet zo vanzelfsprekend dat de gemeenten daarvoor ook geld op tafel leggen. Ook al beschikken ze over een voorkooprecht.

Jos Ansoms van de koepel van de gemengde distributie-intercommunales Intermixt wond er gisteren geen doekjes om: de gemeenten kijken heel anders tegen een investering in Elia aan dan tegen een investering in het gasbedrijf Fluxys.

Een overname van een deel of van het volledige belang van Electrabel in Fluxys wordt gezien als een zeer interessante kans.Gemeentelijk aandeelhouder Publigas beschikt bovendien over voldoende financiële middelen om zelfs het volledige aandelenpakket van Electrabel in Fluxys over te kunnen nemen.

Dat komt omdat de gemeentelijke aandeelhouder op een berg contanten zit nadat het vorig jaar zijn aandelen in Distrigas, het voormalige zusterbedrijf van Fluxys, te gelde heeft gemaakt.

Publi-T, de gemeentelijke aandeelhouder van Elia, staat financieel echter veel minder sterk dan Publigas.



Voilà, dat is meteen duidelijke taal. In concreto betekent dit wel een zeer lelijke streep door de rekening van de Eliadirectie met het oog op de aankoop van het Duitse Vattenfallnet. Indien er immers een akkoord komt met Vattenfall over de verkoop aan Elia moet die aankoop nog door de raad van bestuur van Elia formeel worden goedgekeurd. Deze twaalfkoppige raad van bestuur bestaat voor de helft uit onafhankelijke bestuurders en dus nog een paar Electrabelbestuurders. Het is dus nog geen uitgemaakte zaak dat daar zo makkelijk een ruime meerderheid wordt gevonden om de overname goed te keuren. Door meteen na de aankondiging door de Eliadirectie dat het terug onderhandelde met Vattenfall over de aankoop van hun Duitse net naar buiten te komen met het nieuws dat ze al haar aandelen in Elia te koop zette, gaf Electrabel een zeer duidelijk signaal dat het niet geïnteresseerd was in dergelijke operatie die haar tenslotte definitief in de vergeethoek zou drummen binnen het Elia-aandeelhoudersschap.

Maar Elia wordt meteen ook gedwongen op zoek te gaan naar een betrouwbare partner die nu al weet dat hij zijn participatie meteen zal zien verwateren als de broodnodige kapitaalsverhoging zal doorgevoerd worden om de rekening van de overname te betalen en de blijde intrede van de dominante Australische investeerder zal mogen meemaken...geen rooskleurig vooruitzicht voor een betrouwbare partner. Want je moet dan ook nog zeker zijn dat die niet zou samenspannen met de Australiërs of het is helemaal gedaan met de Belgische pret van Publi T of de Belgische gemeenten.

Het lijkt ons eerder een scenario van een directie die zwaar heeft gegokt ten koste van de Belgische verankering van ons eigen Belgisch Transportnet door uit te kijken naar een strategische aankoop van een ver buitenlands net en die nu het deksel op de neus krijgt van Electrabel omdat er niet werd gesproken met alle aandeelhouders en die dus geen rekening heeft gehouden met alle scenario's. Maar wie zijn wij om dat juist te kunnen inschatten?
Misschien is het ook een opportuniteit voor een andere Europese netbeheerder om zich meteen in te kopen bij de Belgische netbeheerder om alzo inzage te krijgen in het reilen en zeilen bij Elia. Misschien een kans voor het Hollandse Tennet of het Franse RTE om hun invloed uit te breiden binnenin het hart van het Centraal West-Europese (CWE)net? Op zich zou dit geen slechte zaak hoeven te zijn voor zover Elia dan ook aandelen kan verwerven in Tennet en RTE. In dit scenario zouden we zeer vlug een harmonisatie kunnen zien ontstaan binnen de verschillende CWE-netten zoals Europa zou wensen. Maar het blijftt de vraag of dit de echte strategie was die de huidige Elia-directie voor ogen had met de verwerving van het Vattenfallnet????

Het blijft boeiend maar de stilte bij de politiekers is hallucinant en zeker aan de linkse kant is dit onbegrijpelijk en onaanvaardbaar. België dreigt de controle te verliezen over haar eigen Transportnet en geen politicus die hierover ook maar een vraag stelt, geen partij die hierbij een standpunt inneemt. Maar je zou een Franstalige burgemeester benoemen in Kraainem en het land ontploft! De politieke prioriteiten in Belgistan lijken eerder op een partituur van een ondermaatse opéra comique dan op gedegen politieke analyses.

Deze zaak zal echter de toekomst van ons land bepalen en voor een stuk van Europa en we blijven het van dichtbij volgen. In elk geval zijn we nu reeds niet verrast door de volledige nulliteit van onze eigen politici...

Ondertussen gaan de grote manoeuvers rond Fluxys en vooral rond Elia verder want we lazen in de pers dat Electrabel zich volledig wil terugtrekken zowel uit Fluxys wat in de lijn van de verwachtinghen lag als uit Elia wat veel minder verwacht werd.

GDF Suez lost greep op gaskraan en hoogspanning

BRUSSEL - Het lijkt erop dat GDF Suez en Electrabel snel de banden zullen verbreken met Fluxys en Elia, de bedrijven die zorgen voor de verdeling van gas en elektriciteit.

Een volledige verkoop zal GDF Suez heel wat rijker maken. De aandelenpakketten die de Franse energiegroep heeft in beide netbedrijven zijn op basis van de slotkoers van afgelopen vrijdag bijna een miljard euro waard.

De Belgische gemeenten mogen alvast hun geld beginnen te tellen want ze staan op de eerste rij als de verkopen plaatsvinden. Via gemeentelijke investeringsmaatschappijen beschikken zij zowel bij Elia als Fluxys over een voorkooprecht.

Wanneer zullen GDF Suez en Electrabel de eerste stap doen om Fluxys en Elia te verkopen?

Wat het gasnetbedrijf Fluxys betreft is dit voor zeer binnenkort, is te horen. En ook in het geval van het hoogspanningsbedrijf Elia zou het een kwestie van weken zijn.

Dat GDF Suez snel kleur moet bekennen over zijn toekomst als aandeelhouder van Fluxys, is onvermijdelijk. Het Franse energieconcern moet immers snel af van een deel van zijn participatie van 38,5 procent in Fluxys. Dat komt omdat een wet haar eigenlijk al had verplicht om voor 31december van vorig jaar zijn positie in het gasbedrijf te verminderen tot 25procent.

De kans is echter zeer groot dat GDF Suez en Electrabel verkiezen om de band met Fluxys volledig door te knippen.

‘Als dit het geval mocht zijn, staan de gemeenten klaar om het volledige aandelenpakket over te nemen', stelt de Gentse burgemeester Daniel Termont. Termont is ook voorzitter van de gemeentelijke overheidsholding Publigas die vandaag al voor iets meer dan de helft eigenaar is van Fluxys. Hij voegt er nog aan toe dat hij alle dagen een brief verwacht waarin GDF Suez en Electrabel duidelijkheid zullen geven. Publigas beschikt over een voorkooprecht bij de verkoop van Fluxys-aandelen door Electrabel.

Maar er zijn ook aanwijzingen dat GDF Suez en Electrabel binnenkort kleur zullen bekennen over hun toekomst als aandeelhouder van het Belgische hoogspanningsbedrijf Elia. Electrabel bezit nu nog 24,35 procent van dit bedrijf.

Elia is momenteel aan het onderhandelen over de aankoop van een hoogspanningsnet in het oosten van Duitsland. De hoop is dat medio februari de knoop doorgehakt kan worden. In het verleden werd op het Duitse hoogspanningsnet een waarde geplakt van 500 miljoen euro. Het valt te betwijfelen of Electrabel als aandeelhouder nog mee de financiële verantwoordelijkheid wil dragen voor zo'n overname.

Te meer omdat een recente Europese regelgeving omtrent de verdere liberalisering van de elektriciteits- en gasmarkt elektriciteitsproducenten zoals Electrabel verplicht om hun machtsposities in monopolistische netbedrijven her en der in Europa op te geven.

Dat GDF Suez zo snel lijkt af te willen van Fluxys en Elia zou overigens ook ingegeven zijn door de overtuiging dat de Belgische minister van Energie, Paul Magnette, tijdens de periode van het Belgische voorzitterschap van de Europese Unie, werk zal maken van de omzetting van deze Europese regels in nationale wetgeving. Om zo te kunnen tonen dat België ook de eerste van de Europese klas kan zijn bij het toepassen van Europese richtlijnen. Tot nog toe was op het terrein van energie vaak het tegenovergestelde het geval.


Wij zullen hier waarschijnlijk niet de enigen zijn die zich stilaan beginnen af te vragen waar de gemeenten al die sollen zullen halen. Enerzijds het aandelenpakket dat ze wensen over te nemen van Electrabel in Fluxys en daar bovenop het pakket Electrabelaandelen in Elia en vervolgens dan nog misschien moeten deelnemen aan de kapitaalsverhoging van Elia als het dat Duitse Vattenfallnet opkoopt...jawadde. En wij die dachten dat die gemeenten geen rooie duit hadden ...of moeten de gemeentebelastingen omhoog?

In elk geval is het duidelijk dat Electrabel van zijn deelname in Elia af wil vooraleer de verwatering van hun aandeel plaats vindt naar aanleiding van een eventuele kapitaalsverhoging indien Elia het Duitse Vattenfallnet overkoopt. Nu hebben ze nog 24,35 % en een paar bestuurders maar ze zijn meer dan waarschijnlijk niet geneigd om deel te nemen aan de kapitaalsverhoging en dan dreigen ze een verwaarloosbaar aantal percenten over te houden met misschien nog één enkele bestuurder. Dat is natuurlijk niet echt interessant. Maar we zijn toch benieuwd hoe de politieke wereld en de CREG zal reageren op deze grondige wijziging in de aandeelhoudersstructuur van onze nationale netbeheerder...erg benieuwd...we kunnen nauwelijks wachten. Maar het is natuurlijk het seizoen bij uitstek waarin sommige soorten hun winterslaapje houden en de meesten van onze politici behoren tot deze slaapsoorten ...of zijn we verkeerd? Hallo de sossen, hallo de groenen????????Wake up!!!!
