The unemployment rate for young Americans has exploded to 52.2 percent -- a post-World War II high, according to the Labor Dept. -- meaning millions of Americans are staring at the likelihood that their lifetime earning potential will be diminished and, combined with the predicted slow economic recovery, their transition into productive members of society could be put on hold for an extended period of time. And worse, without a clear economic recovery plan aimed at creating entry-level jobs, the odds of many of these young adults -- aged 16 to 24, excluding students -- getting a job and moving out of their parents' houses are long. Young workers have been among the hardest hit during the current recession -- in which a total of 9.5 million jobs have been lost."It's an extremely dire situation in the short run," said Heidi Shierholz, an economist with the Washington-based Economic Policy Institute. "This group won't do as well as their parents unless the jobs situation changes. Al Angrisani, the former assistant Labor Department secretary under President Reagan, doesn't see a turnaround in the jobs picture for entry-level workers and places the blame squarely on the Obama administration and the construction of its stimulus bill."There is no assistance provided for the development of job growth through small businesses, which create 70 percent of the jobs in the country," Angrisani said in an interview last week. "All those [unemployed young people] should be getting hired by small businesses.There are six million small businesses in the country, those that employ less than 100 people, and a jobs stimulus bill should include tax credits to give incentives to those businesses to hire people, the former Labor official said. If each of the businesses hired just one person, we would go a long way in growing ourselves back to where we were before the recession," Angrisani noted.During previous recessions, in the early '80s, early '90s and after Sept. 11, 2001, unemployment among 16-to-24 year olds never went above 50 percent. Except after 9/11, jobs growth followed within two years.A much slower recovery is forecast today. Shierholz believes it could take four or five years to ramp up jobs again. A study from the National Longitudinal Survey of Youth, a government database, said the damage to a new career by a recession can last 15 years. And if young Americans are not working and becoming productive members of society, they are less likely to make major purchases -- from cars to homes -- thus putting the US economy further behind the eight ball. Angrisani said he believes that Obama's economic team, led by Larry Summers, has a blind spot for small business because no senior member of the team -- dominated by academics and veterans of big business -- has ever started and grown a business. The Reagan administration had people who knew of small business," he said. They should carve out $100 billion right now and create something like $5,000 to $6,000 job credits that would drive the hiring of young, idled workers by small business. Angrisani said the stimulus money going to extending unemployment benefits is like a narcotic that is keeping the unemployed content -- but doing little to get them jobs. Labor Dept. statistics also show that the number of chronically unemployed -- those without a job for 27 weeks or more -- has also hit a post-WWII high.

EMPLOYMENT AND UNEMPLOYMENT AMONG YOUTH--SUMMER 2009

From April to July 2009, the number of employed youth 16 to 24 years old
increased by 1.6 million to 19.3 million, the Bureau of Labor Statistics of
the U.S. Department of Labor reported today. This year, however, the pro-
portion of young people who were employed in July was 51.4 percent, the
lowest July rate on record for the series, which began in 1948. (July is
the traditional summertime peak for youth employment.) Unemployment among
youth increased by 1.1 million between April and July 2009, about the same
as in the summer of 2008. (Because this analysis focuses on the seasonal
changes in youth employment and unemployment that occur every spring and
summer, the data are not seasonally adjusted.)

Labor Force

The youth labor force--16- to 24-year-olds working or actively looking
for work--grows sharply between April and July each year. During these
months, large numbers of high school and college students take or search
for summer jobs, and many graduates enter the labor market to look for or
begin permanent employment. This summer, the youth labor force grew by
2.6 million to a total of 23.7 million in July. (See table 1.)

The labor force participation rate for youth--the proportion of their
population working or looking for work--was 63.0 percent in July 2009,
down by 2.1 percentage points from July 2008 and 14.5 percentage points
below its peak for that month in 1989 (77.5 percent). The youth partici-
pation rate was the lowest July rate since 1955 (62.8 percent).

The July 2009 labor force participation rate for 16- to 24-year-old
men, at 64.9 percent, was down by 3.2 percentage points from a year
earlier, and the rate for women, at 61.1 percent, was little changed over
the year. For several decades prior to 1989, young men's July labor
force participation rate showed no clear trend, ranging from 81 to 86
percent. Since July 1989, however, their participation rate has trended
down by about 18 percentage points. Young women's July labor force par-
ticipation rate peaked in 1989 after a long-term upward trend; their
rate has trended down by about 11 percentage points since then.

The July 2009 participation rates for whites fell by 2.1 percentage
points to 66.0 percent. The rates for blacks at 52.9 percent and Hispanics
at 59.4 percent were little changed from a year earlier. For all three
groups, labor force participation rates were significantly lower than
their peak levels reached in July 1989. The participation rate for Asian
youth in July 2009, at 49.3 percent, was little different from July 2008.
(See table 2.)

Employment

In July 2009, 19.3 million 16- to 24-year-olds were employed. This
summer's increase in youth employment was lower than last year's (1.6
million vs. 1.9 million). The employment-population ratio for youth--
the proportion of the 16- to 24-year-old civilian noninstitutional pop-
ulation that was employed--was 51.4 percent in July, down 4.6 percent-
age points from July 2008. The ratio has fallen by nearly 18 percent-
age points since its peak in July 1989. The steep decline from July
2008 to July 2009 reflects, in part, continued weak labor market condi-
tions due to the recession that began in December 2007. (See table 2.)

The employment-population ratio for young men was 52.2 percent in
July 2009, down from 57.9 percent in July 2008. The employment-pop-
ulation ratios for women (50.5 percent), whites (55.2 percent), blacks
(36.4 percent), Asians (41.3 percent), and Hispanics (46.5 percent) in
July 2009 also were lower than a year earlier.

In July 2009, 25 percent of employed youth worked in the leisure
and hospitality industry (which includes food services). Another 20
percent worked in the retail trade industry. (See table 3.)

Unemployment

In July 2009, 4.4 million youth were unemployed, up by nearly 1.0
million from July 2008. The youth unemployment rate was 18.5 percent
in July 2009, the highest July rate on record for the series, which
began in 1948. As with the decline in employment, the increase in
youth unemployment in the summer of 2009 reflected a weak job market.
The July 2009 unemployment rates for young men (19.7 percent), women
(17.3 percent), whites (16.4 percent), blacks (31.2 percent), Asians
(16.3 percent), and Hispanics (21.7 percent) increased from a year
earlier. (See table 2.)

In andere omstandigheden hoor en lees je enkel geweeklaag over de luxe waarin de grootste bandieten zoals een Dutroux schijnen te baden. Je zou haast denken dat elke cel een individuele loft is met plasmascherm en bubbelbad. Maar nu, beste lezertjes is dit paradijs omgetoverd in de hel. Voorhechtenis is erger dan een ondervraging in Abhu Graib en de cellen zijn erger dan de Turkse vergeetputten.
Zelden een ommekeer die radicaler was dan nu. Wij gaan hier geen orakeltaal uitslagen over schuld of onschuld van Meneer Van Steenkiste. Dat is onze taak niet en voor ons blijft ook een baron onschuldig tot het tegendeel is bewezen. Maar dat plotse geklaag over de wantoestanden is hypocriet. Dat is nooit anders geweest. We hebben het hier trouwens herhaaldelijk gezegd met voorbeelden bij. Want het ergste is dat het volledig terecht is wat er nu allemaal wordt geschreven. Alleen is de vraag : waarom nu?
Het zelfde geldt voor de schandalen binnen de Brusselse magistratuur die nu plots de koppen van kwaliteitskranten vullen. Magistraten die met kredietkaarten van dubieuse zakenmannen uitstapjes maken naar de Bab Yum in Amsterdam. Vervolgens blijken die zakenmannen op heel veel begrip te kunnen rekenen bij zeer eigenaardige processen. Politieagenten die als afpersers dienen enz enz. Eerlijk gezegd, beste lezertjes, wij hebben het nooit anders geweten in Brussel. Dus waarom nu?
Ach we zien de wenkbrouwen van sommige lezertjes omhoog trekken. Wat bazelen die kiekens van de Kitoko nu weer over "we hebben het nooit anders geweten? Rechter De Tandt ook genoemd in affaire-Salik/Kid Cool

De affaire-Peeters/De Tandt is geen geïsoleerd incident. Ook geen afrekening tussen politiediensten en Justitie. Het zou gaan om een systeem van chantage en corruptie tussen advocaten, magistraten en bedrijfsleiders. Peeters en De Tandt ontkennen. Dat meldt Trends deze week.

Het werd vorige week duidelijk dat Glenn Audenaert, hoofd van de gerechtelijke politie in Brussel, een brief heeft gestuurd naar minister van Justitie Stefaan De Clerck over een doofpotoperatie bij de Brusselse magistratuur.

Spilfiguren in een mogelijke zaak van afpersing van rijke ondernemers met zwarte vermogens zouden zakenadvocaat Robert Peeters en de voorzitter van de Brusselse rechtbank van koophandel, Francine De Tandt, zijn. Audenaert bevestigde de berichten in De Tijd. Peeters diende klacht in wegens laster en eerroof en beschuldigt Audenaert ervan op goede voet te staan met ondernemers tegen wie Peeters processen heeft ingespannen. De twee thesissen staan diametraal tegen elkaar.

Maar dat is volgens bronnen bij de handelsrechtbank in Brussel niet de kern van de zaak. Volgens hen gaat het niet om een persoonlijke afrekening tussen twee individuen, maar om een diepgeworteld systeem van chantage en corruptie. Speurders en onderzoeksrechters botsen al jaren tegen een politiek-affairistische omerta. Onderzoeksdossiers zouden systematisch worden geblokkeerd en toegedekt door Brusselse topmagistraten, van het Parketgeneraal tot Cassatie. De dag dat de affaire-Peeters/De Tandt in de openbaarheid kwam liepen bij herstellingswerken toevallig ook nog de kelders van de rechtbank van koophandel in Brussel onder water. Daar lagen heel wat hangende gerechtsdossiers.

Affaire Salik/Kid Cool

De zaak Peeters/De Tandt doet in gerechtelijke kringen ook vragen rijzen over de rol van de magistratuur in een reeks andere gevoelige rechtszaken, zoals Sabena, Fortis, Sobelair, Belgolaise-bank, Donaldson en de affaire Salik/Kid Cool. Tussen de zaak Peeters/De Tandt en het faillissement van de Brusselse kledingketen voor kinderen Kid Cool in juni 1999 en de verdere afwikkeling ervan zijn heel wat gelijkenissen.

Zoals speurders na huiszoekingen bij advocaat Peeters spreken van een miljoenenfraude en in zijn computer vonnissen vonden die rechter De Tandt nog moest uitspreken _ Peeters en de Tandt ontkennen beide aantijgingen_ werden bij rechter-commissaris Emile Dereymaeker in juni 2000 huiszoekingen bevolen en op zijn computer aanwijzingen gevonden van mogelijke omkoping door zakenman Salik.

De rechter-commissaris zou meermaals buiten zijn rol zijn getreden nadat Salik Kid Cool in juni 1999 feitelijk had overgenomen. La Dernière Heure publiceerde fragmenten uit dagboeknotities die Dereymaeker bijhield op zijn computer en waaruit blijkt dat de rechter-commissaris van Salik geschenken kreeg en betrokken was bij intieme feestjes. Die bevindingen leidden in oktober 2002 tot de inbeschuldigingstelling door onderzoeksrechter Jean-Claude Van Espen van de rechter-commissaris voor valsheid in geschrifte en corruptie.

Voorgekauwde vonnissen

De media publiceerden ook uittreksels van een merkwaardige bandopname waarvan de inhoud door een gerechtsdeurwaarder werd vastgesteld. Daarin zegt een opgewekte Dereymaeker in een telefoongesprek met Pierre Salik: "Bonjour Pierre, c'est Emile." Waarna de rechter meldt dat hij "zonet een heerlijk dinertje" heeft gehad met mevrouw De Tandt en mevrouw Spiritus _ toen de ondervoorzitter en voorzitter van de Brusselse handelsrechtbank. "Très positif, maar morgen vertel ik je meer over hun ideetje." Dat gebeurde voordat rechter De Tandt een vonnis velde dat nadelig uitviel voor de vroegere eigenaar van de kledingketen Kid Cool, Patrick Abraham.

Daarop vatten de advocaten van Abraham en Kid Cool het hof van Cassatie met een verzoek tot gewettigde verdenking tegen de hele Brusselse rechtbank van koophandel. Een dergelijk verzoekschrift is vaak een laatste proceduremiddel dat advocaten gebruiken als zij menen dat hun cliënt niet op onpartijdige wijze werd behandeld. Want ook hier is er een parallel: zoals in de zaak-Peeters blijkt dat rechter De Tandt in haar vonnissen passages zou hebben overgenomen uit de computer van de zakenadvocaat werden door De Tandt in mei 2000 in de zaak Kid Cool vonnissen geveld op basis van passages die woord per woord komen uit een rapport van de voorlopige bewindvoerder die Kid Cool runde en aangesteld was door de rechtbank van koophandel na het faillissement van de winkelketen. In beroep werden die vonnissen verbroken. Ook in de zaak-Fortis werden vonnissen van De Tandt in beroep teniet gedaan.

Minister van Justitie
Dereymaeker en Salik werden door onderzoeksrechter van Espen in oktober 2002 in beschuldiging gesteld, maar het dossier bleef jaren geblokkeerd. Pas na een brief van Abraham aan toenmalig minister van Justitie Onkelinx concludeerde het Brussels parket begin 2007 dat er "voldoende elementen zijn om verwijzing naar de correctionele rechtbank te vorderen voor Pierre Salik, zijn twee dochters en rechter-commissaris Emile Dereymaeker." De tenlastelegging luidde: respectievelijk actieve en passieve corruptie van een magistraat. Sindsdien werd de zaak nog niet door de raadkamer doorverwezen naar Correctionele.
Tien jaar nadat de kledingketen door de Brusselse handelsrechtbank failliet werd verklaard, is er nog geen klaarheid in de zaak Salik/Kid Cool. De omstandigheden vertonen heel wat gelijkenissen met de zaak van de Brusselse topmagistraten waarvoor Politiedirecteur Glenn Audenaert nu naar Justitieminister De Clerck trekt.

Club 16, comme 16 rue de la Loi


Ils utilisaient de faux documents signés par Martens

BRUXELLES Le Club 16, comme le 16 de la rue de la Loi. C'est de cette façon que se faisaient appeler les 4 membres d'une association plus que troublantes.

Actuellement, ils ne sont plus que trois à être poursuivis par la justice bruxelloise. Le dernier est décédé. A la chambre du conseil, le procureur a requis le renvoi devant le tribunal correctionnel de Pierre S., Pierre D. et Georges M.

Les trois intéressés sont inculpés de faux, de corruption et d'association de malfaiteurs avec l'ancien conseiller d'Etat, Yves Boucquey. Les faits datent de 1997.

En raison de son rang de magistrat, Yves Boucquey avait directement été jugé par la cour d'appel de Bruxelles. En 2001, il avait écopé d'une peine de 3 ans dont un an ferme. L'intéressé avait été reconnu coupable de corruption passive et d'association de malfaiteurs.

Cette association s'appelait Club 16. Cela s'explique par le fait que le quatrième prévenu, aujourd'- hui décédé, et Yves Boucquey étaient attachés au cabinet de Wilfried Martens, à l'époque Premier ministre.

Pierre S. travaillait quant à lui comme ingénieur chez Tractebel. Enfin, Pierre D. aurait été recruté par différentes entreprises, dont la société française Air Liquide. Grâce à cela, il lui était possible d'établir un grand nombre de fausses factures afin de sortir l'argent de la corruption.

En clair, Air liquide a passé un contrat de quelque 125 millions d'euros en 1988 avec la firme néerlandaise DSM, spécialisée dans la distribution d'énergie et de gaz.

Ceci dit, la société Air Liquide ne pouvait pas respecter ses engagements vis-à-vis de la firme néerlandaise. La cause de ce grain de sable dans la machine est les résistances des mandataires locaux et du Boerenbond. Mais pour éviter de devoir payer des pénalités de retard à la DSM, Air Liquide a versé des pots-de-vin et a fait produire des faux documents signés de la main de Wilfried Martens.

De cette façon, Air Liquide pouvait certifier que les retards étaient dûs à des problèmes communautaires et institutionnels propres à la Belgique.

Et cela, la société française Air Liquide ne pouvait pas le prévoir

Les inculpés du Club 16 renvoyés en correctionnelle

Ils gravitaient dans l'entourage de Wilfried Martens, alors Premier ministre

BRUXELLES La chambre du conseil de Bruxelles a ordonné jeudi le renvoi, devant le tribunal correctionnel, des trois derniers inculpés du dossier dit du Club 16, l'un des membres du quatuor, Alain V., étant décédé entre-temps. Pierre S., Pierre D. et Georges M. devront donc répondre devant le juge du fond de corruption, de faux et d'association de malfaiteurs. Des faits présumés commis voici une dizaine d'années avec l'ancien conseiller d'Etat Yves Boucquey.

En raison de son rang de magistrat, celui-ci avait été jugé directement par la cour d'appel et condamné le 7 mars 2001 à 3 ans de prison dont un an ferme pour corruption passive et association de malfaiteurs. Celle-ci avait été baptisée Club 16, comme le 16, rue de la Loi, puisque Yves Boucquey et Alain V. étaient attachés au cabinet de Wilfried Martens, à l'époque où il était encore Premier ministre, tandis que le beau-frère d'Alain V., Pierre S., était ingénieur chez Tractebel.

Autre membre du 16, Pierre D. aurait été, quant à lui, recruté par diverses sociétés, dont Air Liquide une entreprise française pour le compte de laquelle Georges M. intervenait aussi , pour fabriquer un grand nombre de fausses factures afin de sortir l'argent de la corruption.

Air Liquide a passé un contrat de quelque 125 millions d'euros en 1988 avec une firme néerlandaise, DSM, spécialisée dans la distribution d'énergie, de gaz notamment.

Ne pouvant respecter ses échéances en raison de résistances de mandataires locaux et du Boerenbond, Air Liquide aurait versé des pots-de-vin pour arriver à ses fins et produit un faux document signé de la main de Wilfried Martens.

Juge inculpé de corruption!

Un juge consulaire soupçonné d'avoir reçu des cadeaux de l'homme d'affaires

BRUXELLES La famille de Pierre Salik a donné son nom aux fameux blue-jeans
fabriqués en Belgique. L'autre inculpé, c'est le juge consulaire bruxellois Emile Dereymacker, de par ailleurs administrateur-délégué de l'asbl Bruxelles-Promotions (qui organise les 20 km de Bruxelles).

Notre info: les deux sont inculpés par le juge Van Espen de 1) faux, 2) usage de faux et 3) corruption (passive ou active). Leur mise en inculpation s'est faite par courrier jeudi passé.

Rappelons car c'est essentiel qu' inculpé n'a jamais signifié coupable. Salik comme Dereymacker sont présumés innocents. Le juge pense seulement disposer d'assez d'éléments pour considérer que l'un a offert et l'autre reçu divers cadeaux dans un contexte de corruption. Et c'est exceptionnel en Belgique!

Pour faire bref: en 1985, un certain Patrick Abraham lance la marque Kid Cool, du prêt-à-porter chic pour enfants de zéro à 12 ans: toutes les mamans belges connaissent. Le succès est grandiose. Kid Cool, c'est bientôt 2 milliards de chiffre d'affaires et 160 emplois.

En 1999 pourtant, Kid Cool rencontre des difficultés passagères de liquidité. Pierre Salik saute sur l'occasion pour investir quelques centaines de millions. Que s'est-il passé entre les deux hommes? Toujours est-il que Patrick Abraham écarté de Kid Cool s'est adressé à la justice, a vite cru comprendre que les
dés étaient peut-être pipés et a porté plainte. Personne au départ ne l'a cru.


Intraitable, tenace, le juge Van Espen perquisitionne partout: chez Abraham, chez son rival Pierre Salik et chez le juge consulaire qui devait s'occuper de la faillite Kid Cool. Et quand on dit tout, c'est tout: les gens qu'il croise comme cet ancien 1er ministre , les restaurants où il est invité et c'est rarement la friterie de la gare , et des prénoms d'hommes, des prénoms de femmes, le plaisir franc, le plaisir vif qu'il a à rencontrer les uns et les autres.

Emile Dereymacker parle aussi de Pierre Salik, de ses séjours au Zoute, des relations d'amitié franche (à voir par exemple les trempettes dans la piscine des Salik).

Dans son cabinet, Jean-Claude Van Espen croit feuilleter un bouquin d'oenologue à la lecture des très grands vins Château Cheval Blanc, Château des Tournelles de Longueville, Clos du Marquis, Chateau Clos d'Estournel, etc. - qui défilent sous ses yeux. On parle aussi de la sculpture d'un grand artiste, Berrocal.

Le juge soupçonne Salik d'avoir offert des cadeaux au juge consulaire et ce dernier, en les acceptant, d'avoir fait pencher le bras de la justice pour Salik Au détriment de Patrick Abraham. Et tout ça se serait passé à Bruxelles? Nous nous refuserions à le croire si les inculpations de corruption notamment intervenues dans ce dossier 36/99 nous étaient, hélas, confirmées déjà par Jos Colpin, 1er substitut et porte-parole du parquet de Bruxelles

Juge consulaire?


BRUXELLES Un juge consulaire, explique hier le parquet de Bruxelles, n'est pas un magistrat professionnel. C'est un juge issu des milieux commerçants nommé pour une période renouvelable de cinq ans. Ceux-ci ont pour mission d'assister de leurs précieux conseils les magistrats professionnels. Les consulaires ne
siègent que quelques matins par mois. Emile Dereymacker, 61 ans, a d'autres activités à son arc. C'est ainsi, par exemple, qu'il dirige ce syndicat d'initiative (privé) de la ville de Bruxelles organisateur des 20 km de Bruxelles. Inutile de préciser que cette asbl n'est évidemment en rien impliquée dans le dossier du juge Van Espen. Dereymacker préside encore une caisse connue d'assurances. Il a eu des fonctions clés au sein du comité directeur d'une banque. Il exerce ou a exercé des mandats dans plusieurs associations belges et européennes.

Les soupçons ne sont pas minces: corruption. Pas plus tard qu'hier, le parquet de Bruxelles par le truchement du 1er Substitut Jean-Pascal Thoreau, patron de sa section financière a contacté la présidente du tribunal de commerce de Bruxelles pour lui demander de veiller à ce que le juge consulaire ne siège
plus à l'audience tant qu'il n'aura pas été blanchi par la chambre du conseil ou le tribunal correctionnel.

Ce dossier est très bien connu de la présidente Spiritus.

Bouclé depuis un an, le dossier Salik semble en hibernation



Le plaignant, Patrick Abraham, s'interroge sur cette lenteur de la justice

BRUXELLES Question insidieuse posée par un particulier: «Serait-ce parce que l'affaire met un magistrat inculpé en cause qu'elle tarde à venir en chambre du conseil alors que le dossier est bouclé depuis plusieurs mois?»

Ce particulier n'est pas un particulier comme les autres. Il se nomme Patrick Abraham et est connu pour avoir dirigé pendant quinze ans une marque célèbre de prêt-à-porter pour enfants, Kid Cool.

Toutes les mamans belges connaissent. Le succès fut grandiose, 2 milliards (en francs) de chiffre d'affaires et jusqu'à 160 emplois.

Survient, en 1999, une mauvaise passe financière. Un industriel, le roi du jeans, Pierre Salik, saute sur l'occasion et investit quelques centaines de millions.

Que s'est-il passé entre les deux hommes? Nous n'étions pas là, nous n'en savons rien.

Toujours est-il que Patrick Abraham, écarté de Kid Cool, s'est adressé à la justice, qu'il a cru comprendre que les dés étaient peut-être pipés et qu'il a porté plainte. Et qu'au départ, personne ne l'a cru. Et qu'à l'arrivée, le juge Van Espen, qui est tout sauf un petit plaisantin, a fini par inculper M. Pierre Salik de faux, usage et corruption active d'un magistrat commercial, un juge consulaire siégeant au tribunal de commerce de Bruxelles. Le personnage n'est pas le premier venu. Il s'est fort investi dans le monde associatif bruxellois, sportif mondain et touristique.

Un juge consulaire inculpé
de corruption passive

Toujours est-il que le Comité P n'a eu qu'à appuyer sur un bouton du clavier de son ordinateur pour printer une sorte d'agenda intime.

Le juge Van Espen a parcouru le document. Il y a trouvé son cercle de relations, le nom d'un ancien Premier ministre, des noms de restaurants où le consulaire se faisait inviter, des noms de grands crus, la sculpture d'un grand artiste, des noms et prénoms d'hommes, de femmes, le descriptif de scènes cocasses, des trempettes dans la piscine de M. Salik.

Tout ça n'est pas neuf. A déjà même été écrit (DH 8 octobre 2002). Et a valu au juge consulaire confirmé à l'époque par le 1er substitut Colpin, porte-parole autorisé du parquet de Bruxelles d'être inculpé de corruption passive.

Le juge Van Espen a bouclé son dossier depuis 12 mois.

Le dossier, depuis, hiberne Un an d'hibernation.

A ce stade, personne ne parle de juger, encore moins de condamner. Si présomption il y a, c'est bien celle de l'innocence. Ce que le journaliste cherche à comprendre, c'est pourquoi ce dossier bouclé semble hésiter depuis un an à suivre la procédure normale qui devrait l'amener devant la chambre du conseil.

Eventuelle partie civile, Patrick Abraham s'en inquiété auprès du parquet général: celui-ci dispose de certains pouvoirs sur le parquet de première instance.

Ces derniers mois, chacun a pu constater que les tribunaux correctionnels sanctionnaient les lenteurs du parquet en refusant de condamner des personnes qu'ils jugent pourtant coupables: »Vous êtes coupable, monsieur, mais après
tant de temps, vous infliger une peine n'aurait plus de sens.» Bonne justice?

Carnets d'un juge inculpé


Les cadeaux, les femmes, le reste...

BELGIQUE D'un côté, un industriel mis en faillite. Quasi judiciairement dépossédé de sa propre société au profit d'un rival en affaires.

Beaucoup d'argent perdu. De nombreux emplois.

Les dés étaient-ils pipés? Très vite persuadé que tout ne s'est pas déroulé à la régulière, l'industriel s'est posé beaucoup de questions. En particulier sur le rôle joué en sous-main par un juge consulaire intervenu dans la faillite.

La justice s'en est mêlée. L'ordinateur du consulaire a été saisi. Il se fait que ce juge avait la manie de tout noter. Tout... jusqu'aux nombreux petits cadeaux qu'il recevait, effectivement, de l'industriel... rival. Du très bon vin, de grands crus millésimés, du Château des Tourelles, du Fils de Lagrange, du Clos du Marquis. Au moins 96 bouteilles.

Apparemment, le copinage allait plus loin. Le juge consulaire rencontrait régulièrement en privé l'homme d'affaires rival. Voilà en tout cas ce qu'on trouve dans son PC à la date du 22 avril: «Week-end au Zoute dans sa villa. Nous avons nagé dans sa piscine. Il était à poil.»

La décision tombe le 2 juin. Ce jour-là, le tribunal de commerce condamne l'industriel malheureux à stopper ses activités. Le juge consulaire note que, le soir, »nous soupons avec (son concurrent heureux).»

Et encore le 6: «Nouvelle soirée. Superbe buffet avec orchestre de jazz.»

Le juge consulaire passe son 30 août à s'occuper de la faillite de l'industriel malheureux. Mais que fait-il le soir? Eh bien, le juge pas gêné se rend à un »souper (chez l'industriel concurrent) et sa fille. (Celle-ci) me montre ses
cuisses et sa culotte».

Le 5 septembre: nouvelle rencontre hors tribunal avec son ami l'industriel. »Nous rencontrons l'ancien Premier ministre X.» Le 17: «Après-midi de travail. Le soir, souper avec le 1er ministre.» Et le 25: «Souper avec le baron M. et S., ancien chef de cabinet du prince X. Très bonne soirée. Vins délicieux.» Car le juge consulaire aime se distraire des austères dossiers commerciaux.
Exemple. Le 25 août: «Juliette propose à Roland de venir à la maison. Juliette en slip et soutien essaye un manteau de fourrure en petite tenue pour nous exciter. Roland commence à lui sucer les seins pendant que je la déshabille. Ensuite, elle se couche à poil sur le tapis. Roland lui fait des (illisible) pendant qu'elle me (ill.).

»Je lui demande de se mettre à genoux pour me (ill.) et me faire (ill.) dans la bouche. Le soir, nous avons rendez-vous (toujours le même industriel) dans (un
des tout grands restos du pays). Sa fille a des seins énormes. Je la drague pendant qu 'il fait les yeux doux à Juliette.»

Le 10 septembre: «Rz-vs à 16 h. Le soir, souper. J'ai reçu 2 Viagra.»

Le 10 décembre: «Petite visite au bureau. Là, Machin se fait tirer sur le tapis de la salle de réunion, vite et par-derrière. Sa (illisible) n'était pas assez dure. Le soir, souper chez l '(ami industriel) avec le prince V. »

Le 10 janvier: «Truc est venu me montrer des photos de Juliette à poil. Pour le remercier, Juliette lui a fait une (ill.) assise à son bureau. Je b. tellement.
J'ai (...) dans sa bouche. Le soir, nous avons soupé avec (encore et toujours
l'ami industriel). Au menu: caviar excellent.»

Le 8 avril: «Juliette va au parking pour montrer ses cuisses aux gardiens. Un

Italien accepte de recevoir Juliette qui se précipite au rendez-vous. Il est laid et plein de pustules. Pourtant, Juliette va lui prendre sa (illisible) en main et lui montrer son sexe et ses seins.» 13 avril: «A.B. a d'abord pris une douche. Il est fonctionnaire à l'ONSS. Max. 25 ans. ( Illisible ) courte mais large. Juliette se met à poil. Couchée sur le lit, etc.).

Voilà. Il y a vingt ans, un scandale découvert par l'avocat Michel Graindorge éclaboussait le tribunal de commerce de Nivelles (non concerné ici). Cette fois, la justice en est à inculper de corruption...

Il accusait Reynders à tort (11/03/2003)

Condamné à 18 mois, Antonino Costa soutenait que le ministre avait un compte au Luxembourg

BRUXELLES Hier, le tribunal correctionnel a prononcé le jugement dans le cadre du dossier Costa. La justice reproche à Antonino Costa les préventions de faux, usage de faux et accusations calomnieuses.
Costa, ex-employé de la KB Lux, était poursuivi pour avoir accusé à tort le ministre Reynders et un procureur général de la cour d'appel de Bruxelles, André Van Oudenhove.
Le prévenu soutenait que le ministre des Finances avait des comptes au Luxembourg lourds de quelque 191 millions de francs belges, soit environ 4,73 millions d'euros.
C'est en novembre 1999 que cette affaire avait éclaté. A l'époque, le prévenu avait contacté un journaliste du quotidien néerlandophone, De Morgen. Pour convaincre le journaliste de publier ce qu'il avançait, Costa lui avait fourni des extraits de compte. Par la suite, il s'est avéré que ces extraits étaient en réalité des faux.
Lors de son réquisitoire, le procureur du tribunal correctionnel avait notamment souligné qu'il n'était pas fort compliqué de falsifier des extraits de compte.
Selon le procureur, cela peut se faire très facilement à partir d'un logiciel informatique basique, comme Word. Il en conclut qu'il y a une réelle atteinte à l'honneur et à l'intégrité du ministre et du procureur. Alors que la justice et la politique souffrent d'une partie de la population qui pense que tout est pourri, l'intervention de Costa n'a pas amélioré la situation.
Dès le début de l'affaire, le ministre Didier Reynders avait souligné que ses propres dédommagements iront intégralement sur le compte du CPAS de Liège.
Costa a par ailleurs été condamné à une peine d'emprisonnement par le tribunal correctionnel du grand-duché de Luxembourg en 2000 pour des faits similaires commis au préjudice d'une autre banque.
Le tribunal correctionnel de Bruxelles a condamné hier Antonino Costa à une peine de 18 mois de prison et à une amende de 2478,93 euros.

Le fils d'un magistrat est poursuivi en justice (12/03/2003)

Philippe Demanet doit répondre d'un large trafic de voitures de luxe

BRUXELLES Philippe Demanet n'est inconnu de personne dans le milieu judiciaire. Non pas forcément comme un criminel ou un malfrat, mais en tout cas comme étant le fils du procureur général de Mons.
Ce Mardi, Le fils Demanet était présent devant le tribunal correctionnel de Bruxelles. Il doit répondre globalement d'un trafic important de voitures volées. Actuellement âgé de 40 ans, Philippe Demanet réside au Madagascar. Trois autres prévenus sont également poursuivis: Bernard Adam, 37 ans, Romano Sarti-Toddei, 43 ans, et Alain Kempinck, 31 ans. Seul Romano était absent pour raisons médicales.
Les faits se sont globalement déroulés entre 1990 et 1996. Tout tourne autour du trafic de voitures de luxe: Porsche, BMW, Mercedes, Jeep,... Pour arriver à leurs fins, les prévenus auraient utilisé tous les moyens possibles et imaginables. En passant du vol de voitures par le recel sans oublier l'arnaque aux compagnies d'assurance et la falsification de P.-V. de police, les prévenus ont ainsi détourné des dizaines de véhicules dans les 4 coins de l'Europe.
En 1993, Demanet, Adam et Sarti-Taddei ont falsifié des procès-verbaux, notamment de la police de Playa d'Aro en Espagne, pour simuler le vol d'une Porsche 911 Carrera. Demanet et Adam ont aussi augmenté le prix de vente d'une Porsche 911 d'occasion au préjudice de Metropolitan Lease.
Les deux mêmes prévenus ont également simulé l'accident d'une Porsche à proximité du barrage de l'Eau d'Heure en juillet 1993. Le but était de récupérer de l'argent auprès de leur compagnie d'assurance, la Commercial Union.
Bernard Adam a aussi vendu entre 1990 et 1994 une série impressionnante de voitures volées réalisées à l'aide de fausses factures, numéros de châssis transformés,... BMW était la marque de prédilection. Le parquet a relevé les véhicules suivants: 3 BMW 325, 2 BMW 525, 2 Porsche 911, 1 BMW 520, 1 BMW 318 et 1 Mercedes 250!
Adam et Kempinck sont également poursuivis pour le vol d'un Jeep en juillet 1996. Bernard Adam doit enfin répondre d'un nombre impressionnant de recel sur les voitures suivantes: Une Mercedes 250, 3 BMW 325, 2 BMW 525, une BMW 520, une BMW 318 et une Porsche 911. Les faits se sont déroulés entre 1990 et 1994.
Le réquisitoire du procureur et les plaidoiries de la défense ne sont pas attendus plusieurs semaines.

Le magistrat conduisait ivre


Le président du tribunal de Namur a eu un accident de roulage. L'alcotest s'est révélé positif...

NAMUR En dépit de vastes campagnes de sensibilisation en matière d'ivresse au volant et alors que les services d'aide Bob ou Responsible Young Drivers se multiplient, personne n'est à l'abri d'un faux pas. La preuve en est cette histoire bien embarrassante pour le président du tribunal de Namur, M. Christian Panier.

Le 26 décembre, vers 3 h du matin, M. Panier circulait en voiture avenue de Tervueren, à Bruxelles. `Je sortais d'une soirée chez des amis. Le revêtement routier était humide et glissant. Mon véhicule venait d'être doublé par une Volvo qui avait immédiatement dû s'arrêter pour respecter la signalisation. J'ai freiné. J'ai glissé. Et je n'ai pas pu empêcher la collision´, précise le président du tribunal de Namur.

Cet accident n'a occasionné que des dégâts matériels, mais Christian Panier ne pouvait pas, en raison de sa fonction, a-t-il expliqué, rédiger lui- même le constat amiable.

La police de la zone Montgomery est donc intervenue sur les lieux de l'accident pour arranger la situation. Constatant l'état d'ébriété du magistrat qu'ils n'étaient pas censés connaître , les policiers ont décidé de pratiquer un alcotest.

Celui-ci s'étant révélé positif, les policiers n'ont eu d'autre choix que de retirer son permis de conduire au magistrat namurois.

Christian Panier est bien sûr juridiquement présumé innocent. Son dossier a été transmis au parquet général de Liège qui est le seul à pouvoir décider des suites ou de l'absence de suites à lui donner. En effet, lorsqu'un magistrat se rend coupable d'une infraction quelle qu'elle soit, c'est toujours le parquet général qui est saisi.

Comme n'importe quel citoyen, le magistrat namurois encourt bien évidemment une sanction pénale pour cette infraction au code de la route. En outre, il pourrait aussi se voir infliger une sanction disciplinaire allant, dans le cas présent, du simple avertissement à la suspension pure et simple de ses fonctions. Mais dans l'attente de l'avis du parquet général, la seule répercussion perceptible de cette mésaventure est que, le lendemain matin, Christian Panier n'a pas pu être présent au palais de justice pour présider la chambre du conseil et a dû être remplacé. Il a ensuite immédiatement et normalement repris son travail.

De snuivende jetset

Onder de rubriek 'Het relatienetwerk van M. Nihoul' vermeldt het commissierapport onder meer de Brusselse dancing Le Mirano. In het kader van haar zoektocht naar bescherming had de commissie goede redenen om zich te interesseren voor de Mirano. Kort voor hij werd vermoord, wees FN-ingenieur Juan Mendez de Mirano aan als de sleutel tot de opheldering van de aanslagen van de Bende van Nijvel. In haar rapport blijft de commissie echter op de vlakte. 'De heer Nihoul kwam er ook vaak', staat er zuinigjes. In de eerste helft van de jaren tachtig werd een opmerkelijk groot aantal prominente figuren van de Brusselse jetset, zowel uit de zakenwereld als het uitgaansleven, strafrechtelijk vervolgd. Heel wat strafonderzoeken, die het Brusselse parket toen opende, liepen ook uit op veroordelingen. Enkele namen: wapenhandelaar Roger Boas van de firma Asco, de bekende jeansfabrikant Pierre Salik, graaf Hervé d'Ursel en zijn schoonbroer baron Benoit de Bonvoisin, graaf Richard van Wijck, graaf Giorgio Gherardi Dandolo, vastgoedmakelaar Ado Blaton, ex-minister Jacques Van Offelen, Fernand Ullens de Schooten, Freddy Liénard, beleggingsadviseur Léo Levy. Later zou ook de meest vooraanstaande van allemaal, minister van staat Paul Vanden Boeynants, veroordeeld worden. Bijna al deze mensen hadden gemeenschappelijke kenmerken: ze hadden een aanzienlijk vermogen, ze werden een na een veroordeeld voor het opzetten - via stromannen - van grootscheepse fraude-operaties om de fiscus te bedriegen en, last but not least, ze kenden elkaar allemaal.

Hun namen prijkten alle in het jaarboek van de leden van de Cercle des Nations, een selecte club gevestigd in een imposant gebouw in de Franklin Rooseveltlaan, tegenover de ULB in Brussel. De pronkerige salons van deze Cercle - waar geen vrouwen waren toegelaten - vormden in de periode 1970-1985 zowat het hoofdkwartier van de deftige politieke rechterzijde. Wekelijks werd er gedineerd en geconfereerd met de top van de zakenwereld en de diplomatie, samen met figuren van extreem-rechts en de onderwereld. Het zou vele jaren duren vooraleer de onderzoeksrechters en parketmagistraten van Brussel tot de slotsom kwamen dat achter de schermen van de Cercle des Nations in werkelijkheid een criminele bende opereerde die haar tentakels uitstrekte tot ver in de bankwereld, de politiek en ook het Brusselse uitgaansleven. Het uitgaansleven van de jongere generatie uit de betere Brusselse kringen van die jaren speelde zich vooral af in een drietal privéclubs: de Mirano, een dancing in Sint-Joost-ten-Node, het Circus in Ukkel en de Parc Savoy in Brussel. Deze laatste club, oorspronkelijk opgericht door VdB's boezemvriend en vastgoedkoning Charly De Pauw, werd geleid door André Blaton. De Parc Savoy fuseerde later met de firma Codenat. Die stond toen al jaren in voor het restaurant van de Cercle des Nations.

Op wandelafstand van het parlement

De zonen en dochters van heel wat bekende zakenlui uit het entourage van Paul Vanden Boeynants en zijn politieke vrienden bezochten deze drie privéclubs. Heroïne en cocaïne gingen er vlot van hand tot hand. Dat er in die kringen veel geld circuleerde sprak vanzelf. Soms werden er in dit milieu ook criminele plannetjes beraamd, zoals de poging tot ontvoering van de zoon van Charly De Pauw, die uiteindelijk toch mislukte maar wel de aandacht trok van de justitie. Een van de leden van de Cercle des Nations die in dit milieu privé-seksfuiven organiseerde en er ook cocaine in omloop bracht was Philippe Cryns. Die was destijds de directeur van het cosmeticabedrijf Laboratoire du Docteur Renaud. Cryns was een medestichter van de Parc Savoy. Een van de dealers die hij goed kende, Alexis Alewaeters, stond ook bekend als organisator van speciale seksfuiven en in 1985 werkte hij ook een tijdlang als bediende bij de firma Cadreco, het kantoor voor juridisch advies van Annie Bouty. Cryns was niet alleen samen met de families De Pauw en Blaton en baron Benoit de Bonvoisin een veel gezien aanwezige op de seksfuiven in de Parc Savoy. Men trof hem, deels met dezelfde mensen, ook aan in de Mirano, op amper vijfhonderd meter van het parlement. In 1985 werkte Cryns ook een tijdje als een soort pr-agent voor een gerenommeerd restaurant, gelegen in het Terkamerenbos. Hij was toen ook nog altijd een discreet organisator van speciale fuiven waar cocaïne gesnoven werd.

Heel wat figuren uit de adel, het zakenleven, alsook ook de theater- en de filmwereld bezochten toen de Mirano. Maar op 14 april '85 overleed in dit milieu plots Jean-Jacques B. aan een overdosis. Hij had een cocktail ingeslikt bestaande uit cocaïne, heroïne, alcohol en geneesmiddelen. B. was de schoonzoon van een hooggeplaatst Brussels magistraat en dit keer kreeg de zaak dus wel een gerechtelijke staart. Cryns, organisator van de 'feestjes' in de Mirano, en een reeks rijkeluiszonen werden, samen met enkele dealers, ondervraagd en aangehouden. Onderzoeksrechter Bellemans schreef ook een internationaal aanhoudingsbevel uit tegen Sammy Pavel, toen al een wereldwijd bekend filmregisseur. Hij had, zo luidde de aanklacht, vanuit Rio de Janeiro een lading cocaïne naar Cryns verstuurd. Het onderzoek spitste zich toe op de cocaïnehandel die via Cryns ook vertakkingen had naar Nederland. Op 24 februari '86 stonden in deze cocaïnezaak in Brussel tenslotte dertien personen uit voornoemde Brusselse salons terecht. Onder hen Cryns, Pavel, Alewaeters en Eric Verhaeghe de Naeyer. Deze laatste, telg uit een bekend adellijk geslacht, was al enkele jaren eerder als bendeleider betrokken geweest bij overvallen, onder meer op een bank, die met dure wagens waren gepleegd, "voor de kick". In een verslag over dit proces citeerde De Morgen op 26 februari 1986 de openbare aanklager. Die zei over de toen 39-jarige Cryns dat deze "over ontzettend grote inkomsten beschikte en vaak bij hem thuis fuiven organiseerde waarop talrijke jongeren, ook minderjarigen, werden uitgenodigd". Ook daar werd uiteraard cocaïne gesnoven. Heel wat jongeren had Cryns voordien via de Mirano leren kennen. Aan het slot van het proces, in oktober '86, kreeg Cryns tenslotte drie jaar effectieve celstraf, Pavel twee jaar met uitstel, Alewaeters zag zich bedacht met vijf jaar cel, Stéphane Devriendt met drie jaar met uitstel, Jacques De Windt, een antiquair, met achttien maanden.

In tegenstelling tot bij ons in Vlaanderen, Wallonië is weer een gans ander verhaal, kan je daar dus op een sterke linkse partij stemmen. De slimsten onder jullie begrijpen dat we het dan niet hebben over de SPD als we over een linkse partij hebben. We spreken dus over Die Linke. Deze partij is geen samenraapsel van allerlei uiterst linkse groupuscules zoals in Frankrijk de nieuwe partij rond Besancenot. Die linke zijn een samenvoegsel van de vroegere Oost-Duitse PDS en ontevreden sociaal-democraten rond Oscar Lafontaine. Blijkbaar liggen ze ook in ruzie met ons aller Wikipedia zoals we kunnen lezen op:

Die Linke of DIE LINKE. (Duits, 'Links') is een Duitse socialistische politieke partij, opgericht op 16 juni 2007 als fusie van de socialistische Linkspartei (eerder PDS) en de sociaaldemocratische WASG. De partij plaatst zichzelf aan de linkerkant van de gevestigde partijen. Het voorzitterschap van de partij wordt gedeeld door Lothar Bisky en Oskar Lafontaine.

De partij heeft in 2008 54 leden in de Bondsdag, waar het qua fractiegrootte de vierde partij is. In de opiniepeilingen was de partij in oktober 2008 de derde partij van Duitsland.[1] Met 76.139 leden op 30 september 2008[2] is Die Linke ook qua aantal leden de derde partij van Duitsland.


Controverses

De partij werd in 2006 vanwege zijn programmapunten door de Duitse veiligheidsdienst (Bundesamt für Verfassungsschutz) ingeschaald als extremistisch en wordt sindsdien in de gaten gehouden.[3]

Een van de leden van Bondsdag namens Die Linke, Lutz Heilmann was voorheen in dienst van de Stasi. Om bepaalde aspecten rond zijn persoon te verhullen voerde hij een kort geding tegen het Duitse Wikimedia chapter. Door de rechterlijke uitspraak werd de link van de website www.wikipedia.de naar de Duitstalige wikipedia (de.wikipedia.org) gedurende het weekend van 15 en 16 november 2008 tijdelijk verwijderd.




Wanneer we wat neuzen op hun officiële site kunnen we enkel vaststellen dat die heel professioneel is uitgewerkt en dat daar zelfs een heel partijprogramma valt te raadplegen dat duidelijk links geïnspireerd is. Misschien moet Gennez daar eens een kijkje gaan nemen om de smoel van de SP-a wat beter te profileren. In elk geval is het in Duitsland zo dat de functie van zweeppartij daar wordt vervuld door deze linkse partij. Of je dat nu leuk vindt of niet. Wij vinden het alleszins veel interessanter dat links de verveldende klier is voor de traditionele partijen in plaats zoals in Vlaanderenland allerlei rechtse en nog rechtsere partijen die zelfs nu nog openlijk pleiten voor de vrije markt na al wat we zien gebeuren hebben en wat er ons nog te wachten staat. Dus duimen wij vanuit onze luie zetel zondag voor Die Linke, stasi of niet...

En het is een partij die tenminste onverschrokken durft pleiten voor de terugtrekking van de troepen uit Afghanistan. Hier in onze gewesten kennen wij niet onmiddellijk een partij die zoiets maar durft te suggereren! Terwijl miscchien niet de meerderheid van de bevolking maar toch een belangrijke minderheid zichg daar terecht vragen over stelt. Kan iemand ons hier een zinnige uitleg komen geven wat we daar te zoeken hebben? En denkt er nu werkelijk één Vlaams politicus dat we daar als grote overwinnaars uit die oorlog zullen komen? Meent er één politicus dat we daar de democratie verdedigen? Allez hop kom het ons hier eens uitleggen. Wij luisteren met een bereidwillig koppel oren....
We zullen hen wat helpen om een realistische visie te kunnen ontwikkelen over de problematiek van Afghanistan. Want als we moeten afgaan (let op de woordspeling) op de normale berichtgeving voor Jan met de pet en Marie met de schort dan krijgen we de indruk te kijken naar de westerns met john Wayne. De goeien hebben dan wel helmpjes, ontzettend indrukwekkende beschermingspakken en allerlei gesofistikeerde wapens bij terwijl de anderen er nogal haveloos op sandalen en met tulbanden en baarden bijlopen. Die laatsten zijn natuurlijk de stinkende slechterikken. Helaas lijken die bebaarde stinkerds aan de winnende hand en dit zonder blitse humvees en geheimzinnige drones....eigenaardig toch. Hoe zou dat nu toch komen? Wel wij weten het ook niet maar we vonden alleszins een artikel dat misschien wat meer inzicht geeft in deze oorlog tussen goeien en slechten.

Karzai is the Problem, Not the Solution

Why Afghan Intellectuals Live in National Despair

Afghanistan’s president, Mr Hamid Karzai has many faces, like the colors of his billowing chapan. One shines in his antipathy towards Afghan intelligentsia and another in his indissoluble bond with the Afghan warlords. His election campaign exposes this rancor more explicitly nowadays when he is using his usual tactics— intimidation, bribery and back door dealings—to secure himself a second term in the upcoming election and help warlords and his siblings hold on to ill-gotten wealth and power. The security situation in the south, east and west of the country is worsening on a daily basis where a surging war is going on between the US-led Western forces and the Taliban insurgents. These are the Pashtun dominated areas, where Karzai is becoming increasingly unpopular.

In these areas, most Afghan intellectuals are living at the interface between a corrupt regime and anachronistic religious extremism. Many independent intellectuals and Western educated specialists and scholars find it very difficult serving their war-torn country, because of increasing insecurity and the fear of being kidnapped for ransom. For some who, like me, dare to go to their ancestral country to serve it, an atmosphere of constant psychological pressure from invisible criminals force them to leave the country within weeks or months. During my six months stay in Kabul last year, I noted disillusionment, feelings of frustration and anxiety taking hold of the Afghan intelligentsia. I found many intellectuals disgruntled and worn down.

Most Afghan expatriates live without the protection of the rule of law. Most well-educated Afghanis still flee the country, yearning resettlement in the West. Most of the kidnappings go unreported and criminal gangs terrorize intellectuals and businessmen with impunity. The plague afflicts much of Afghanistan, especially Kabul and other major cities. The criminal gangs, like drug lords, are linked to the high-ranking officials of Karzai’s government. Overall erosion of security, a floundering economy, high levels of unemployment and corruption-riddled officials in the government are offered as the main reasons for the wave of kidnapping for ransom. For some ex-pats, however, Kabul has been a California gold rush during the past eight years. The enfants terribles have been mostly linked to Karzai’s upper echelon or powerful warlords. They have the jobs of their dreams, enjoying extra security and receiving special protection. The Afghan community of expatriates can be divided into two categories. The first is a large number of Afghan experts in different fields of science, communication and humanities who are working as executives of the NGOs, high-ranking government officials and advisers to the cabinet members and the President and Vice presidents. Most of them are aging retirees with academic qualifications as old as twenty to forty years. Karzai has turned their lives around.

The second category has more genuine experts who held positions on the basis of their merit but their numbers are shrinking due to increasing insecurity. A large number of Afghan intellectuals are working in the booming media industry, which is regrettably more divisive than uniting. There are more than a dozen TV stations with 24-hour broadcasting, hundreds of radio stations, hundreds of newspapers and journals across the country. But the media are owned and controlled by political and religious parties, warlords, and the new political elite who are roundly committed to their sectarian agendas. Most of the TV programs have very dull and banal productions. This leaves foreign productions to fill the gap. Indian soap operas and movies are the staple of Afghan TV networks. Most of them have hypnotizing themes of false hope versus utter despair with forceful melodramatic endings. Hollywood productions with veiled romances also have a large share of the TV shows.

Iran’s close ties with Karzai have made way for Iranian penetration, as well as Shiite politics in Afghanistan, which manipulates Dari speaking and Shia-Afghan ethnic minorities. To this end, Iran sends millions of dollars to fund sectarian programs in the Afghanistan which is directed against the Pashtun majority of the country and the West. Karzai has just endorsed barbaric marriage legislation that allow a Shia husband to deny food to his wife if she refuses his sexual demands. The new laws also save a rapist from persecution, by paying so called “blood money”. Such a law is passed at a time that Westerners and Afghans are being killed on the daily basis in the country. In addition, Iran is also pushing to install Mr Abdullah Abdullah as an alternative to Karzai. Abdullah, a GP, was Karzai’s ex-foreign minister. He has an open anti-Pashtun sectarian agenda. He is representing the Northern Alliance militia.

Karzai’s government remains impotent to stem the country’s hyper-corruption. Many of his cabinet members and odious warlords have built up staggering personal fortunes, including luxury homes in Kabul and multimillion businesses. Karzai’s brothers turned the government into their own playground. Millions in state revenue, foreign aid and drug money goes directly into their coffers. Their obsession is very much like leading characters in Dostoevsky’s The Brothers Karamazov, with the exception that the Karamazovs had tried to destroy each other, but Karzais are in close collaboration. On August 9, 2009, The New York Times Magazine published a fifteen-page story on the Karzais and their hands in corruption, extortion and drug dealing. During the past eight years, Western money in the billions that Afghanistan had never seen has gone down the drain. As recently reported by The Time, Karzai pays a notorious warlord, Rashid Dostum, accused of gross human right crimes, $80,000, a month, while the average salary for a state employee is $50 to $100. He was recently reinstated as the Afghan army chief of staff.

In the World Bank’s 2008 ‘Doing Business’ report, the efficiency of the Afghanistan justice system was the lowest in the world, below Iraq and Pakistan. Despite spending billions of dollars the Afghan national army and police force are far from beating the growing insurgency. During my stay in Kabul I noticed a growing unwillingness among the Afghan national army and police to fight. Many told me openly that they will be looking at deserting the minute they find themselves outside Kabul. As Karzai’s government grows more and more corrupt, the insurgency fills the void, operating in more places than ever. In recent months, the insurgency began to expand well beyond its traditional stronghold in the south and east towards a growing penetration of the north of the country, where its presence was until last year, minimal. The President is locked up in his heavily fortified presidential palace and we have seen more of his junkets to the Western capitals than Afghan cities.

In the south and east of the country, which have borne the brunt of the war and chaos, Karzai is growing increasingly unpopular, and the country’s long-suffering Pashtuns see him as nothing but a puppet in the hands of the warlords of the Northern-Alliance—a hodge-podge mix of ex-communists and militia of Afghan ethnic minorities. This has alienated the Pashtuns making them an endless recruitment source and a unifying factor for the Taliban insurgents who are predominantly Pashtuns. In addition, thousands have been streaming into the country from Pakistan to lend a hand to their cousins. More than 40 million Pashtuns are divided by an imaginary and disputed border, Durand Line—drawn by the British East India Company on November 12th, 1893.

Historically, Pashtun or Afghans were known as genetically coded with war since Herodotus. ‘With the Afghans,’ Friedrich Engels wrote in 1857, ‘war is an excitement and relief from the monotonous occupation of industrial pursuits.’ The recent Anglo-American air and ground operations (Panther’s Claw and Strike of the Sword) in the volatile south of Afghanistan have done little to break the current military stalemate in the country. Instead, these military operations, the biggest since the ousting of the Taliban regime from power in 2001, have increased insurgent’s steady stream of guerilla attacks, leaving heavy losses on both sides.

Karzai is certainly a problem not a solution anymore. His re-election will likely strengthen the Taliban politically and ideologically and harden their hold over the south and east of the country sooner than many imagine. But all signs, however, indicates his re-election. In the eyes of the Afghans, this would mean that the result of the election is preordained. Powerful and opportunistic warlords are all backing Karzai for they know very well that under Karzai they will be able to continue to loot the country unimpeded.

Despite mounting evidence of Karzai’s warlord problem, there are speculations in Kabul that the Obama administration, unsure of an alternative, is backing his re-election, or making a power-sharing arrangement between Karzai and two other leading contenders. This would mean that a known devil is better than an angel unknown. The imperative of the moment for the Obama administration is to devise a new policy towards Afghanistan and look beyond Karzai and a warlord-sponsored government. Karzai’s re-election or his inclusion in any settlement will destabilize Afghanistan further and blocks Western efforts to bring a lasting peace in this country.

Business as usual. De uitzondering is het oppakken van bedrijfsleiders uit de top van het Belgisch management omdat ze zich zouden bezondigd hebben aan het misbruiken van informatie die ze hadden in de ene firma en die eigenlijk de andere firma waar ze eveneens de leiding hadden niet goed uitkwam enz enz. Nu goed, een kleine blik op een aantal Belgische bedrijven en hun topmanagement spreekt boekdelen. Pure inteelt en vrienden onder mekaar. Men helpt mekaar aan lukratieve mandaatjes die er eigenlijk moeten in bestaan om een controlerende functie op het bedrijf uit te oefenen. Vergeet dat dus gewoon. Alles wordt bedisseld in de viersterrenrestaurants en de privéclubs als de Warande, de Cercle Gaulois en nog een paar andere illustere oorden. Ons kent ons en basta uit. Ondertussen kraakt het ganse systeem maar niemand ligt er echt wakker van. De federale staat en twee regio's zitten totaal aan de grond en niemand ligt er wakker van. Men bedisselt allerlei zaken tussen energieproducenten en de federale staat om wat geld in het laatje te krijgen en verkoopt in feite het principe van de zogenaamde geliberaliseerde energiemarkt. Niemand ligt er wakker van. Pas op men heeft dat eerst door onze strot geramd net alsof iedereen plots maar de helft zou moeten betalen van zijn energiefactuur...Ondertussen hebben we dat dus duur betaald en nu schrijft de pers terecht maar onbeschaamd "Electrabel en SPE zijn bereid om de nucleaire taks te betalen maar ze vragen garanties voor hun monopoliepositie op de Belgische markt. Men noemt dit zelfs onbeschaamd "de monopolierente". Benieuwd wat Europa daarvan zal denken. Hallo Neelie!

Regering heeft grote haast, Electrabel heel wat minder

BRUSSEL - ANALYSE Electrabel in luxepositie in onderhandelingen over kernuitstap De federale regering rekent op een forse bijdrage voor de begroting als de energieproducent zijn kerncentrales langer open mag houden. Electrabel is bereid geld op tafel te leggen, maar laat zich niet opjagen. De komende dagen krijgen we gegoochel met nucleaire miljoenen en miljarden.

'Elk woord dat we zeggen, is gevaarlijk. Dit is heel delicaat', klinkt het bij een van de direct betrokkenen. De onderhandelingen tussen de federale overheid en Electrabel zijn volop aan de gang en de nervositeit aan regeringskant is groot.

Op het begrotingsconclaaf dat de regering dit weekend houdt, zal er nog geen uitsluitsel zijn over de nucleaire cijfers. De beslissing om de kerncentrales langer open te houden, valt volgende week pas. Dan moet het finale rapport van de Gemix-commissie, over de ideale energiemix voor ons land, rond zijn. Officieel wordt op basis daarvan beslist, maar vier van de vijf regeringspartijen hebben al duidelijk laten verstaan dat de centrales langer open moeten blijven. Bij de PS liet de klik wat langer op zich wachten, maar hij is intussen wel gemaakt.

De hamvraag is hoeveel Electrabel op tafel zal moeten leggen. Veel hangt af van de extra winsten die het kan maken. De energiewaakhond Creg heeft daarover een rapport bezorgd aan minister van Energie Paul Magnette (PS). Door de versnelde afschrijving van de centrales en de vrijmaking van de elektriciteitsmarkt zullen de producenten Electrabel en SPE sowieso 3,9 miljard euro extra opgestreken hebben. Dat is de winst tot en met het einde van de huidige exploitatievergunning van de zeven kerncentrales. Daarvoor betaalde Electrabel in 2008 een bijdrage van 250 miljoen en wordt dit jaar gerekend op 500 miljoen (zie tabel).

Maar als alle centrales tien jaar langer open mogen blijven - voor alle duidelijkheid: een scenario dat nu niet ter tafel ligt - levert dat volgens de Creg nog eens 12 miljard extra winst op. Blijven ze twintig jaar langer draaien, dan stijgt dat bedrag tot 16,8 miljard.

Als alleen de oudste drie kernreactoren - Doel 1 en 2 en Tihange 1 - tot 2025 open mogen blijven in plaats van tot 2015, verwacht Electrabel een miljard extra winst. Het moet dan wel 800 miljoen euro investeren in onderhoud en vernieuwing. Bij de elektriciteitsmaatschappij geven ze toe dat het om een voorzichtige winstprognose gaat. Volgens de Creg gaat het om veel meer winst. De recentste berekeningen, die nog niet aan Magnette zijn overgemaakt, komen uit op een veelvoud van dat bedrag.

Electrabel heeft er zich bij neergelegd dat het zal moeten betalen. Niet alleen voor de extra winsten, maar ook voor het behoud van zijn monopoliepositie. Een mogelijk scenario gaat uit van maximaal 250 miljoen euro per jaar. Dat is 'all-in': Electrabel wil dan niet meer horen van de 250 miljoen die het nu betaalt voor de afgeschreven centrales.

Het kabinet-Magnette bevestigt dat er niet gewoon een 'monopolierente' mag worden opgeteld bij de huidige bijdragen. 'Maar we moeten wel de achterpoortjes sluiten', zegt zijn woordvoerder. Electrabel recupereert zijn bijdrage aan de overheid nu gewoon door minder vennootschapsbelasting te betalen. Ook de manier waarop de energieproducent gebruik maakt van de notionele-interestaftrek, is PS'er Magnette een doorn in het oog.

Behalve de hoogte van de bijdrage zijn er nog andere vraagtekens. De bestemming van de Electrabel-bijdrage is nog een discussiepunt. Electrabel wil die vooral gebruiken voor de ontwikkeling van hernieuwbare-energieproductie. Naar Nederlands voorbeeld wil het die fondsen zelf beheren. Electrabel onderhandelt nu zowel met Magnette als met premier Van Rompuy (CD&V). Electrabel-topman Jean-Pierre Hansen is een gewiekst onderhandelaar. Bovendien zit hij in een luxepositie. Het is immers de regering die haast heeft, niet hij. De begroting moet op 13 oktober rond zijn, als Van Rompuy zijn State of the Union houdt. Electrabel heeft zo'n deadline niet.


Wij zijn hier op dit blogje altijd blijven beweren dat men de nucleaire centrales langer moest open houden. Niet omdat wij vriendjes zijn van Electrabel. Evenmin omdat wij voor de kernenergie zijn. Dat zijn wij niet, wij zijn zelfs erge tegenstanders van dat soort dingen MAAR doodgewoon omdat er momenteel geen alternatief is in België waardoor ook de zwaksten onder ons en dat zijn er heel veel, want we spreken niet enkel van vervangingsinkomens en kansarmen, betaalbare energie kan gegarandeerd worden. Een failliete staat zal immers niet lang de alternatieve energie blijven subsidiëren en vroeg of laat wordt die dure alternatieve energie onbetaalbaar voor een groot deel onder ons. Dit is sociaal onaanvaardbaar en de Groenen en sommige linksen mogen het tegendeel beweren maar wij vinden energie een basisbehoefte waarmee zuinig moet worden omgesprongen maar die betaalbaar moet blijven voor iedereen. Hopelijk slagen we er binnen de kortst mogelijke tijd in om voldoende betaalbare hernieuwbare energie te produceren om die kerndingen te sluiten. Op dit ogenblik is dit echter nog niet het geval en dat is nog lange tijd zo en dus hebben we in België geen alternatief. Of dat op deze manier moet worden onderhandeld lijkt ons duidelijk. Neen. Maar wegens het totale onbenul van onze politieke leiders in het energiedossier is ook hier weer geen alternatief. De rooien en de groenen hebben er alleen maar voor gezorgd dat de wet op de kernuitstap het kostenplaatje voor de overname van Electrabel door Suez heel interessant heeft gemaakt. De waarde van de verlenging van de kerncentrales zat dus inderdaad niet in de waarde van het aandeel Electrabel op het moment van de overname.
Voor één keer gaan we mee in de redenering van beleggers. Ze hebben overschot van gelijk. Spijtig zijn ze natuurlijk, dat is de aard van het beestje, uit op meer sollen en zien we hier enkel het oom Dagobertsyndroom. Wij vinden het spijtig dat op deze manier een Belgisch topbedrijf op goedkope manier in handen is gevallen van een Franse en vooral weinig scrupuleuse groep zoals Suez-GDF. Herinneren jullie nog de spyware die onze vriend Hansen installeerde in opdracht van de overnemer van zijn eigen bedrijf? Opgepast Suez was één van de eerste bedrijven met een ethische code die door het voltallige personeel moet worden nageleefd of buiten... Hansen werd schuldig bevonden maar kreeg opschorting...en de ethische code ....die geldt blijkbaar alleen voor het klootjesvolk. En nochtans klinkt de inleiding van deze code erg veelbelovend voor simpele duiven als we zijn:


INLEIDING
De uitdrukking van onze waarden en het respect voor onze ethiek worden
in de eerste plaats belichaamd door het integere gedrag van de
bestuurders en medewerkers van GDF SUEZ in alle situaties. Iedereen
die in naam van een onderneming van de Groep optreedt, moet zich
bewust zijn van deze verplichting. We zijn er evenwel van overtuigd dat
de groep een organisatorisch kader moet uitwerken om die waarden
en ethiek gemakkelijker tot uiting te brengen in professionele gedragingen
en praktijken. Het Ethics en Compliance Programma van GDF SUEZ
moet de voornaamste organen voor interne werking beschrijven
die de Groep heeft ingesteld om het geheel van vragen omtrent ethiek
en compliance in overeenstemming met ons Charter en onze waarden
te behandelen.
Naast de definities van de vereiste organisatie, weten we ook dat ethiek

Beleggers vragen faire prijs van GdF Suez

De regering is niet de enige die naar de kerncentrales lonkt. Beleggers eisen een betere prijs.

Beleggers vechten al jaren de manier aan waarop de Franse groep GdF Suez, volgens hen veel te goedkoop, het grootste Belgische energiebedrijf binnenhaalde. Dat gebeurde in een context van een opmerkelijke politieke onverschilligheid, die niet alleen beleggers veel geld heeft gekost, maar ook de Belgische economie, luidde de aanklacht eerder deze week voor het hof van beroep in Brussel. ‘De waarde verbonden met het langer openhouden van de kerncentrales werd nooit verrekend.'

Belegger Erik Geenen, die bekendheid verwierf in het dossier van de Nationale Bank van België (NBB), hield het hof voor dat België vanwege zijn energiemix bij de landen met de goedkoopste energieprijs zou moeten horen. Meer dan de helft van de elektriciteitsproductie is afkomstig van afgeschreven kerncentrales. ‘Maar toch zitten we bij de dure landen', zei Geenen. Hij beschuldigde GdF Suez van misdadig opzet bij het binnenhalen van Electrabel.

De procedure die Geenen voert, is de laatste procedure tegen de biedprijs van GdF Suez op Electrabel die voor het hof van beroep in Brussel loopt. De pleidooien werden eergisteren opnieuw overgedaan omdat de kamer van het hof van beroep opnieuw samengesteld moest worden als gevolg van de Fortis-saga. Bij de eerdere debatten was Christine Schurmans nog een van de zetelende raadsheren, naast kamervoorzitter Paul Blondeel. De nieuw samengestelde kamer bestond nu uit Paul Blondeel, E. Bodson en S. Gadeyne.

Blondeel zat de achttiende kamer voor van het hof van beroep, die het arrest velde dat bepaalde dat de aandeelhouders van Fortis hun zeg moesten kunnen doen over de ontmanteling van hun groep. Blondeel heeft nu opnieuw een symbooldossier op zijn bord.

Geenen nam het hof mee naar februari 2004, een jaar voordat GdF Suez zijn bod op Electrabel bekendmaakte. De Franse groep installeerde toen spionagesoftware op het hoofdkantoor van Electrabel om de handel en wandel van de Belgische bedrijfstop van Electrabel te kunnen nagaan. De affaire bracht Jean-Pierre Hansen, de toenmalige nummer twee van Suez, in ernstige verlegenheid. Hansen werd schuldig bevonden, maar kreeg strafopschorting.

De spionagezaak verziekte de sfeer tussen Parijs en Electrabel en Electrabels ceo, Willy Bosmans, werd in september 2004 gedwongen tot ontslag. Bosmans had in 1999 Tractebel- en Electrabel-baas Philip Bodson opgevolgd, die toen ook al tot ontslag was gedwongen. Geenen beschuldigde GdF Suez er ook van dat gedelegeerd bestuurder Gerard Mestrallet op de aandeelhoudersvergadering van Electrabel in 2005 loog toen hij verklaarde dat hij niet zou bieden op Electrabel.

Volgens Geenen was de enige bedoeling de koers van Electrabel te drukken, zodat GdF Suez zo goedkoop mogelijk Electrabel kon binnenhalen. GdF Suez maakte op 9 augustus 2005 zijn bod op Electrabel bekend. In juni 2007 volgde een uitrookbod op de aandelen die GdF Suez nog niet had. Geenen eist een prijsverbetering van 200 euro per aandeel. Hij beweert dat de gemiddelde beurskoers van het staal van energiebedrijven waar GdF Suez bij zijn biedprijs naar verwees, met 86 procent was gestegen. ‘Als je die 86 procent toepast op de koers van Electrabel op de dag van het eerste bod en vergelijkt met de prijs van het uitrookbod, was de uitkoopprijs 200 euro per aandeel te laag.'

In november zou het hof van beroep zijn arrest vellen. Al wie zijn aandelen inbracht in het uitrookbod, komt in aanmerking voor een eventuele prijsverbetering. Het is de derde keer dat Geenen in het Electrabel-bod naar de rechtbank trekt.


Dus hoe naiëf kan je als politieke partij zijn te denken dat je onmisbare kerncentrales kan sluiten terwijl alles er op wijst dat we in België al een tekort hebben van ongeveer 30%. 30% die we verplicht zijn in te voeren voornamelijk van uit Frankrijk. Een invoer die op de meeste dagen volledig uit de Franse kerncentrales komt. Sluiten van de Belgische kerncentrales zou enkel de invoer verhogen (mits de uitbreiding van de internationale hoogspanningslijnen) een invoer die sowieso uit de Franse kerncentrales zal komen omdat deze goedkoop stroom leveren op constante basis. Dit in tegenstelling tot de nog goedkopere energie uit de Zwitserse en Franse waterkrachtcentrales die echter seizoensgebonden kunnen leveren namelijk bij dooi van de sneeuwlagen in het gebergte.
Deze dwaze en totaal irrationele maar populistische manier van politiek bedrijven heeft er enkel toe geleid dat België dus volledig afhankelijk is geworden van buitenlandse beslissingen wat betreft energiebevoorrading. Ze hebben dus een buitenlandse groep in zulke sterke onderhandelingspositie gebracht dat onze staat hen een monopolie zal garanderen. Een prachtiger voorbeeld van staatskapitalisme is dus amper in te denken...De staat als behoeder van monopolies...Met dank aan de groenen en de rooien...maar ze hebben hun principes natuurlijk! In feite kan je er hen van verdenken smeergeld te hebben gekregen van Suez. Spijtig genoeg zijn ze daar waarschijnlijk te dom voor. Dat hopen we dan toch tenminste. Zeker ben je daar nooit van.

Trouwens monopolies zoals onze federale staat die nu willen bevestigen om hun lege kassen te vullen zijn altijd een gevaarlijk beestje. Dat was vroeger al zo met het oude Electrabel en dat zal nu enkel verergeren aangezien de macht van een groep als Suez-GDF vele malen groter is.
Wij vonden een prachtig voorbeeld van misbruiken door een monopolie dat trouwens absoluut niks te maken heeft met Electrabel noch met Suez. Enkel als mooi voorbeeld in het hartje van een land dat elders de democratie verdedigt en waarnemers stuurt om te zien dat verkiezingen netjes verlopen. Het lezen waard en misschien moeten we dit als een soort parabel beschouwen die kan dienen als waarschuwing voor wat er ons nog te wachten staat:

The recent announcement of the pending merger of Election Systems & Software (ES&S) of Omaha, Nebraska with Diebold/Premier has raised warning flags that a monopoly in vote counting will be the inevitable result. See the maps attached here for the coverage of the new ES&S.

Suspicions of rigged ballot-counting via manipulation of computer-transmitted data reached a fever pitch one year ago with the affidavit filed in federal court by Stephen Spoonamore, a business associate of Mike Connell, the leading Republican Party specialist in IT and web development. Spoonamore's affidavit was explosive, because the whistleblower revealed that Mike Connell had informed him that radical Republican operatives could have manipulated the results of elections including the presidential election of 2004 and the general election of 2006. An attorney sent a letter to then Attorney General Michael Mukasey that stated:

“We have been confidentially informed by a source we believe to be credible thatKarl Rovehas threatened Michael Connell, a principal witness we have identified in our King Lincoln case in federal court in Columbus, Ohio, that if he does not agree to "take the fall" for election fraud in Ohio, his wife Heather will be prosecuted for supposed lobby law violations."
Mike Connell died on December 19, 2008 while piloting his small airplane near the Akron airport.

The nature and circumstanced of Connell's death raised suspicions about the entire controversy swirling around him at the time of his fatal air crash.

ES&S has a very interesting Republican pedigree including a major investment by Carolyn Hunt of the well-known right-wing Texan family. The following is an account of the company's dubious origins:

Republican Senator Chuck Hagel disclosed in public documents that he was the Chairman of American Information Systems and claimed between a $1 to 5 million investment in the McCarthy Group. In 1997, American Information Systems purchased Business Records Corp. (BRC), formerly Texas-based election company Cronus Industries, to become ES&S. One of the BRC owners was Carolyn Hunt of the right-wing Hunt oil family, which supplied much of the original money for the Council on National Policy.

In 1996, Hagel became the first elected Republican Nebraska senator in 24 years when he did surprisingly well in an election where the votes were verified by the company he served as chairman and maintained a financial investment. In both the 1996 and 2002 elections, Hagel’s ES&S counted an estimated 80% of his winning votes. Due to the contracting out of services, confidentiality agreements between the State of Nebraska and the company kept this matter out of the public eye. Hagel’s first election victory was described as a “stunning upset” by one Nebraska newspaper.

ANTWERPEN - Als de Scheldeverdieping uitblijft, wordt Nederland economisch gestraft. De Antwerpse havenschepen heeft gisteren zwaar uitgehaald.

De Antwerpse schepen van de Haven, Marc Van Peel (CD&V), heeft gisteren Nederland de mantel uitgeveegd tijdens een toespraak voor de verzamelde bedrijfs- en politieke kopstukken van Zeeland in Middelburg. Volgens hem probeert Nederland met drogredenen het uitstel van de Scheldeverdieping goed te praten of er zelfs begrip voor te vragen. ‘Er heerste zowel bij bewindslui als bij de publieke opinie een groot gevoel bedrogen te zijn.'

Hij vertelde ook aan het Zeeuwse publiek wat hij tegenwoordig doet wanneer hij Nederlanders ontvangt in het Antwerpse stadhuis. Dan zet Van Peel de stadhuisramen open om het verhaal te doen over het standbeeld van Brabo op de Grote Markt. ‘Ik heb het dan over de jonge held die de hand afhakte van de reus die de vrije doorvaart op de Schelde blokkeerde.'

De Antwerpse schepen van de Haven zei dat het nu al schadeclaims regent omdat de Schelde nog niet is verdiept. Samen zijn ze al goed voor meer dan 70 miljoen euro, zegt de gedelegeerd bestuurder van de haven, Eddy Bruyninckx.

Marc Van Peel waarschuwde dat Vlaanderen niet van plan is om alleen maar te dreigen met economische tegenmaatregelen. ‘Ze zullen gewoon genomen worden.'

Het ziet er overigens naar uit dat het Antwerpse havenbestuur al de daad bij het woord heeft gevoegd. Het heeft een nieuwe voorrangsregeling aan Antwerpse sluizen ingevoerd waardoor al het scheepvaartverkeer van en naar Nederland – via de Schelde-Rijnverbinding – aan de sluizen al het andere scheepvaartverkeer moet laten voorgaan. Dat zal heel wat vertraging opleveren voor de binnenvaartschepen die pendelen tussen Nederlandse havens en bedrijven en overslagterminals langs de Vlaamse kanalen en rivieren.

De schepen van de Haven sprak de krasse taal tijdens de Zeeuwse Oesterpartij, een jaarlijkse informele bijeenkomst van Zeeuwse en Vlaamse bedrijfsleiders en politici. Dit jaar bleven de Vlamingen weg uit protest tegen het uitstel van de Scheldeverdieping. Vanuit Antwerpen was alleen Van Peel naar Middelburg afgezakt om uitleg te geven over de Vlaamse boycot.

Van Peel zei dat onze noorderburen er niet voor terugschrikken om allerlei mythes in stand te houden en misverstanden te cultiveren. Zoals het Nederlandse argument dat zij in een rechtsstaat leven en om deze reden de beslissing van de Raad van State om de verdiepingswerken te schorsen, moeten naleven. Volgens Van Peel heeft de Nederlandse regering met haar beslissing om de natuurmaatregelen uit de Scheldeverdragen niet uit te voeren de rechtsstaat zelf met voeten getreden.

Vooraleer  troepenversterkingen te sturen naar jullie waterforten, vestingen en steden aan de zuidgrens willen we jullie toch even geruststellen. Wij, Belgen hebben natuurlijk historische rechten op Zeeuws-Vlaanderen en Noord-Brabant (Eindhoven en 's Hertogenbosch). Daar hoeven we zelfs niet meer over in discussie te treden. Wanneer jullie nu gewoon dat stukje Belgenland vreedzaam overhevelen naar ons, en hier sugggeren we dat er eventueel een mogelijkheid in zit om dit naar Wallonië over te hevelen...dan besparen jullie Batavia veel narigheden. Tenslotte verstaan de Vlamingen van dat taaltje dat er daar in Zeeuws-Vlaanderen gebrabbeld wordt even weinig als van het Frans boven de taalgrens dus.... En stel je even voor welke leuke perspectieven dit zou openen bij de volgende communautaire gesprekken wanneer in plaats van Ollanders de Walen de toegang tot de Antwerpse haven zouden controleren? Leute bij de vleet.
Het taaltje van Noord-Brabant valt iets beter te verstaan maar daar is een aanhechting bij de Provincie Luik een niet te versmaden mogelijkheid . We gaan tenslotte niet het Limburgs gezongen taaltje zich laten uitbreiden naar het Noorden. En Antwerpen is al zo vol van zichzelf dat hier zeker geen uitbreiding moet overwogen worden.
Nu, wat denken jullie hiervan? Mooi voorstel toch?
Want wat staat er jullie anders te wachten? Een economische blokkade die deze tegen Cuba zal doen verbleken, beste Unoxmutsen. Concrete voorbeelden bij de vleet. Maar we beperken ons tot een paar van de verschroeiendste sancties. Het Antwerps stadsbestuur zal geen Ollandse kaasblokjse bij het aperitief meer presenteren tijdens banketten, de Antwerpese stadsplantsoenen zullen niet meer worden verfraaid met tulpen, een zeiktax voor de Ollanders die tegen de kathedraal plassen van 1000€, het onderwaterzetten, in de beste 14-18 traditie, van het ollands gedeelte van het verzonken land van Saeftinge, en vreet jullie Zeeuwse mosselen en jullie maatjes maar lekker zelf op! Ha, jullie sidderen en beven reeds...
We weten dat er steeds met jullie valt te onderhandelen in het volste vertrouwen. Dat hebben we geleerd uit de Fortissaga (Fortis-Olland eisen we trouwens ook terug tegen een symbolische €) dus kies eieren voor jullie geld,  geef ons gewoon terug waar we recht op hebben en doe ons een lol. Onderhandel met deelstaat Wallonië hierover zonder de Federale noch de Vlaamse component van Belgistan  te kennen...Jààààààren pret gegarandeerd en geen boot die nog aanmeert aan een Antwerps dok want de Walen zullen eerst het kanaal van Charleroi moeten uitbaggeren, de luchthaven van Bierset uitbreiden en ze hebben al hun geld aan Bernie Ecclestone verkwanseld bij het dobbelen ergens in Francorchamps....dus blijven de boten  allemaal in Rotterdam. Gesnapt beste kezen? Wel waar wachten jullie op? Worden we nu uitgenodigd op Soestdijk?
We verwittigen onze madammen al vast dat ze zich een nieuwe hoed aanschaffen, afgesproken?

Dominico Vulpiani tears a sheet from his memo pad and sketches a map for me. He draws a road and two small rectangles to indicate vehicles. Then he draws little circles in the rectangles to show where everyone was sitting: Miran in the front seat with the driver, Ilaria in the back behind Miran, the bodyguard, Mahamoud standing in the back of the pickup. Vulpiani looks like a goofy Jack Webb. He's got the black buzz cut, a bit of girth that he carries well and slightly crooked teeth. He's the director of D.I.G.O.S. The Division of Investigations and Special Operations of the Questura Di Roma, the Italian police. He has been supervising the police investigations into Ilaria's death for two years. Though he's never been to Mogadishu, and none of his men have ever been to Mogadishu, they have interviewed witnesses who have. It's clear however that Vulpiani and his men have a big problem: Four years after the fact, with no forensic evidence, and no reliable witnesses they can never solve this case. At best, they can make it go away, which is what they seem intent on doing.

There are two ways to do an investigation, Vulpiani lectures. You can start off asking why she was killed and then try to figure out who killed her. Or you can just look at the evidence, just the facts, (he actually says, "just the facts") and determine who killed her and then try to figure out why. You can dismiss the parents, he says. They have taken the first approach. His office, he says, has chosen the second.


The police, he tells me, have a witness to the shooting. He's a young guy who goes by the name Jelle. Jelle turned up when the Italian government in 1977, under pressure to investigate the torture charges and solve the Ilaria case sent a special envoy, Ambassador Giuseppi Cassini, to Mogadishu. Cassini found Jelle during one of his investigative trips to Mogadishu. On the day Ilaria was killed, Jelle was apparently hanging around outside the Amana hotel looking for work with any journalist who might come by.

According to Jelle, once Ilaria's pickup had been cut off, and the two men jumped out of the car, Ilaria's bodyguard Mohamoud started firing while Ali put the car in reverse and eventually backed into a wall because he was keeping his head down and not seeing where he was going. Jelle said that the men in the blue Land Rover fired all of their shots from 20 to 30 meters away. Security guards from the Amana hotel, hearing the shooting, came out, and fired on the attackers driving them away. The attackers then fled. One of them was killed. Ilaria and Miran must have been shot with rounds from an AK 47 from a distance. It was a botched robbery or kidnapping, a case of microcriminality, Vulpiani says.

Vulpiani also tells me that he heard that Ilaria's body guard fired first, turning what might have been a simple robbery into a double murder. I had heard that as well on the night of the killing. According to the first information I had, Mahamoud, Ilaria's bodyguard panicked when the car was cut off and began to fire at the attackers. He only had seven rounds in his rifle and quickly ran out of ammunition. He then jumped out of the truck and fled on foot. Vulpiani seemed delighted to hear this. It fit nicely into the theory that it was a botched robbery. Mahamoud, I knew, was capable extreme panic. Nine months earlier I had been with him when he had panicked and fired first. Perhaps luckily for me, he had fired at American soldiers who were polite enough to aim over our heads when they fired back.

But, I continued, it would seem to me that if Mahamoud was firing at the attackers, they would fire back at Mahamoud, not at the unarmed passengers in the car. Vulpiani doesn't have an answer.

Ambassador Cassini joins us in Vulpiani's office while we're talking. He's been very helpful to me in Rome, and checks with me constantly to see how the story is coming. Cassini says that Jelle identified Hashi Omar Hassan, they guy who's now imprisoned in Rome, as someone who was in the Land Rover that ambushed Ilaria. According to Jelle, Hashi didn't fire. Jelle also said he later asked Hashi why he and his friends had attacked the journalists. Hashi is said to have replied that it was a robbery attempt.

And where is Jelle now?

Well, there was a slight problem with Jelle, Vulpiani said. On Christmas eve of 1997 before he was supposed to testify against Hashi, he disappeared. "We believe he's working as a mechanic in Germany." Hashi, on the other hand, was still in jail.

I paused after listening to their story. It made so little sense on so many levels. I've seen people hit in the head with a round from AK47 or M-16 assault rifle before. The high velocity bullet enters the skull and the body is snapped like a whip. The entrance wound is small, but the exit wound is another matter. The shell entering the skull flattens and turns and it carves a bulldozer path through the head. The exit wound explodes, spraying skull, hair and brain matter. That's not what Ilaria looked like.

It seems to me, I said, that determining what kind of bullet hit her would be the easiest part of this case, certainly more reliable than a witness like Jelle who just might have been looking for a ticket out of Somalia. Incredibly, no autopsy was done on Ilaria immediately after she was shot. Photos were taken of her body by a medical doctor aboard the Garibaldi. But those photos and the medical report, like so other things in this case, have disappeared. The medical officer who wrote the report, told Ilaria's parents that it appeared to him that Ilaria had been assassinated.

Ilaria's body was exhumed twice for autopsies. The first one was inconclusive. The most recent, in January of 1998 concluded that Ilaria was shot at close range, that when she was shot, she had curled up in the back seat of the truck and placed her hands over the back of her head, that the bullet took off the small finger of her right hand. The autopsy team consisted of six doctors, three chosen by Ilaria's parents, three by the police. The report is very clear. But the policemen in the room where I was sitting said simply that they didn't believe it, didn't believe the report because it contradicted their witnesses. Perhaps the bullet had slowed down because it went through the windshield, someone offered. That didn't make much sense, either. Though passing through glass and other material might slow a high velocity round it will also make it begin to wobble or tumble. If the bullet had passed through the windshield Ilaria would not have had a clean entry wound. The police would not accept what their own forensic report said. It was a clean shot to the head that didn't pass through anything.

As for the robbery or kidnapping theories, whoever was close enough to shoot Ilaria would have been close enough to accomplish any of those tasks, which they didn't. Nothing was taken from the car.

.In Mogadishu, everyone knows everyone, especially when cars are involved. I would drive around town with my crew and Osman, my driver, would know who owned every vehicle on the road. He could tell from 100 feet away when an approaching car was possible trouble. The guys I travelled with could eyeball almost anyone in the city and link him via three or four degrees of separation to someone else who could then be identified as friend or foe. In a city where everyone was armed and loyalties were divided along the lines of extended families, survival depended on that kind of information.

It is impossible that no one knew who owned the blue Land Rover, not a common vehicle in Mog. It's not likely that no one could identify any one of the seven gunmen. Ilaria's bodyguard and driver maintained for years that they had no idea who the killers were. Ali, Ilaria's driver, testified as much the first time he was brought to Rome. After Jelle disappeared, Ali was brought back, given asylum in Italy and he suddenly remembered that Hashi had indeed been in the car.

My first instinct upon hearing this, however, was that it proved that Hashi had in fact not been in the car. It was always my experience that whenever a crime was committed in Mogadishu, if the people in power wanted to find out who did it, all they had to do was spread the word. The criminals generally turned up. Obviously, no one wanted to solve this one. And since her killers were lolling about at a tea stand in plain view, in front of Ilaria's driver and bodyguard whom they made no effort to kill, driving a vehicle that would have been easily identified, they obviously thought there was no reason to protect themselves. It's very clear that the people who killed Ilaria and Miran had some very powerful connections, and nobody is about to turn them in.

The Italian laws governing "institutional secrets" prevented me from speaking with Omar Hashi, but I did speak to his lawyer, Douglas Duale. Duale's is a tall, thin, immaculately dressed ethnic Somali with a tight gray beard. From his office you can see the Basilica of St. Peter's. The walls are covered with reproductions of Italian Renaissance art. Duale emphasizes immediately that he is more Italian than Somali. In fact, he was born in Ethiopia and has spent most of his life in Italy and Europe. The first thing he does is open a bottle of champagne and he will keep my glass full and bubbling for the duration of our four-hour discussion.

I'm a bit wary at the beginning our meeting because of what I've been told about him. Both Cassini and Vulpiani described an insane man who made no sense, so I almost expect him to start blubbering madly. After I arrived in Rome I asked Cassini several times for Duale's contact number. But every time he dismissed me saying that I really didn't want to talk to him.

Duale, however, though slightly eccentric, seems about as crazy as F. Lee Bailey. His speech is measured and careful. Duale represents both Hashi and Boqor "King Kong" Musa. While Musa is in the port town of Bosasso, he has come under some scrutiny since he was the last person Ilaria interviewed.

According to Duale, Hashi was among a group of 19 Somalis detained by Italian soldiers at the old port in North Mogadishu. As Hashi tells it, he and 18 others had hoods placed on their heads, had their hands behind their backs and were thrown into the harbor. Hashi and one other were able to pull a Houdini act and wriggle free, but 17 of the prisoners died. Duale is convinced of the truthfulness of this story from his client.

When I respond with skepticism to Hashi's entire story, Duale becomes indignant. During the Operation Restore Hope he tells me, Somalis accused Canadian, Belgian, and Italian Soldiers of committing atrocities. The Canadian special forces tortured a young Somali boy to death. Nobody would have believed the Somalis' claims except that in each case the soldiers took photographs and wrote letters and diaries documenting the atrocities. If it wasn't for the evidence those soldiers provided against themselves, no one would have believed the Somali victims. He has a point - but he hasn't proven one.

The upshot of Hashi's version of events is this: In Mogadishu, Cassini, Jelle, and a few other Somalis working with Cassini approached him with a deal. If he went to Rome and testified that he had been abused by Italian soldiers he would be compensated with a lot of money. All he would have to do is then testify that as far as he knew, most of the other abuse complaints on file were false. He would also have to testify that he was in the blue Land Rover, that he didn't actually fire a gun himself, and the motive in attacking Ilaria's car was robbery.

We're at the end of the evening and at the end of the champagne. "The killing of Ilaria Alpi was entirely an Italian affair," Duale concludes. "It was a hit."

It's late in the evening when I leave Duale's office. A light mist falling on Rome. I'm buzzed from the champagne and everything seems to be glittering. I decide to walk for a bit through the city, but then I recall that at one point during the interview Duale looked at me and said, "these people will kill to stop the truth from coming out." I gaze at the lights on the piazza. This is Rome. Europe. It's not Mogadishu. I decide to take a cab back to my hotel.

The headquarters of RAI just outside of Rome has all the charm of a maximum security prison. A series rectangular concrete structures are surrounded by high, electrified, barbed wire fence. Along one of those fences, on the outside, is a street called via Ilaria Alpi.

Ilaria worked at RAI-3, in the news division, which is known as Tg3 (Telegiornale 3). It was her dream job. Each of Italy's television stations has a political heritage. Raiuno, Raidue and Raitre, were controlled at one time by the Christian Democrats, the Socialists and the Communists respectively. Raitre was the smallest with the fewest resources. In 1987 a man named Sandro Curzi was put in charge of Tg3. Curzi was a well known leftist commentator in Italy and something of a hero to Ilaria. He wanted to build Tg3 as a more even-handed professional news organization, an organization made up of young aggressive reporters who would do with their legs what the station didn't have the money to do.

Curzi told me that he thought most Italian journalists were lazy and cowardly, that they practiced Grand Hotel journalism when they were abroad, and were satisfied to read wire copy when they were home. Ilaria was everything that Curzi wanted in a reporter. He had left Tg3 by the time she went to Somalia, but the new directors of the organization maintained the high opinion they had of Ilaria. Her life and death are still a palpable presence in the halls of Tg3. Her colleagues will drop anything to spend some time talking about her.

One of RAI's journalists, Maurizio Torrealta is writing a book about Ilaria's case. Like her parents, he believes that the key is in the final interview with King Kong. And he thinks it has something to do with the fishing boats that were hijacked off the coast of Bosasso.

When I met Torrealta he was carrying fat books full of official testimony about the Ilaria Alpi case and the abuse and torture cases. In part of that testimony, General Fiore, Italy's last commander in Somalia says that his staff had plans for a military intervention to recapture the fishing boats. We both agree that this attention to some hijacked boats was strange; boats were hijacked all the time off the Somali coast.

The faction leaders who controlled Bosasso had an arrangement with the local militia. In exchange for their "defense" of territorial fishing waters they are allowed to make their own deals and demands with the companies operating the hijacked boats. At the time, King Kong was negotiating the ransom that would be paid for the ship.

Torrealta went back to interview King Kong recently and asked him if he was afraid to talk about the situation with the fishing boat. Yes, he answered. "Because I know that in general, those companies involved in the fishing industry are also involved in other activities - especially those with Italian interests," he said. Torrealta asks King Kong if he told Ilaria anything specific. King Kong hesitates; then says "I can't say.....I don't know."

Torrealta pressed him harder: Is it possible Ilaria was killed because she knew there were arms aboard that ship?

This time King Kong answers, "It is quite possible, because it is evident those ships carried military equipment for different factions involved in the civil war."

After Ilaria and Miran's death, some of their colleagues came to the Sahafi Hotel and took her things away. They packed her TV equipment and her notebooks. They took cash out of her duffel to pay the hotel bill. An inventory of her possessions was taken onboard the Italian naval vessel, the Garibaldi. That inventory included all of her notebooks, but not her missing camera. Then her body was helicoptered back to the American morgue in Mogadishu, which had refrigerators.

The following morning a brief ceremony took place. The metal caskets were draped with Italian flags; they received the military honors in the presence of the Italian ambassador, the military chaplain, General Fiore and other officers. The bodies were flown on a G-222 transport plane to Luxor. In Luxor the coffins were switched to a DC-9 sent by the Italian government and proceeded to Rome.

Sandro Curzi and others who knew Ilaria's work habits said that she was a scrupulous note-taker. Somewhere between Luxor and Rome the notebooks were taken. On board the plane were members of the Italian military, journalists from Tg3, RAI's general manager, Italian secret service, and members of the diplomatic corps. None of those people was ever interrogated. Things, after all, do get lost.

The last thing that Georgio Alpi said to me when I left his apartment was that he now suspected Giancarlo Marrocchino was somehow behind his daughter's death. Back home in New York, I watch Carlos' video over and over again of Giancarlo supervising the extraction of Ilaria's and Miran's bodies from the Toyota pickup. He was the first person on the scene, which is not surprising. North Mogadishu was his turf. And it's also not surprising that he looks unruffled. Death was a way of life in Mogadishu. Then Giancarlo says to the camera, "They were somewhere they shouldn't have been." And I wonder if I'm listening to Giancarlo, the protector of Italian journalists commenting that Ilaria should have been using his bodyguards and cars, or if I'm listening to Giancarlo the gunrunner saying that Ilaria shouldn't have been asking questions about fishing boats in Bosasso. Suddenly I'm aware that this particular street in Mogadishu never seemed that dangerous to me. I had driven down it dozens of times before and never given it a second thought. I returned the day after Ilaria's death, and many times after, feeling perfectly safe and in control.

Dit geeft natuurlijk een erg ontluisterend beeld over vele zaken. Zo onder ander de manier waarop een bepaalde soort journalisten zich laat manipuleren, en de rol van bepaalde Europeanen tijdens de Somalische burgeroorlog waaraan trouwens ook onze Belgen hebben deelgenomen met de bekende beschuldigingen van martelingen als gevolg... maar één ding is duidelijk: er zijn dus niet alleen verliezers geweest. Sommigen hebben er duidelijk van geprofiteerd op de meest perfide manier om hun zaakjes te regelen...

Als er meer dan 80% van een product geproduceerd wordt door twee spelers moet je al erg naïef zijn te geloven dat het spel eerlijk wordt gespeeld. Z3eker niet als de kleinste volledig afhangt van de grootste om aan goedkope energie te gertaken via de nucleaire productie van de andere...
MAAR wat er bij ons niet in kan is dat men grijpt naar zulke methodes van invallen en dat alvorens de discussie op te starten over de inbreng van de Electriciteitsproducenten om het gigantiscghe gat te dichten in de Belgische staatskas. We verklaren ons nader: Vermits de prijsmanipulatie een structureel probleem is dat al ettelijke jaren aansleept zou een verstandig politicus een structurele oplossing nastreven. Niet dus. Veel machtsvertoon en spierballengerol. Dan zullen we een tijdje niks horen. Zogezegd om het onderzoek zijn gang te laten gaan en als er genoeg druk is gezet sterft alles een stille dood via een dading of een stilzwijgende overeenkomst om wat sollen af te dragen aan de lege staatskas. Probleem van de baan? Neen! Want diegene die de dupe geweest is van de prijsmanipulatie wordt niet vergoed voàor de geleden schade. Tenzij je het etalen van minder belastingen zou zien als een schadeloosstelling. Maar zo zien wij het dus niet.
Misschien had een verstandige regering doodgewoon nooit het controlecomité voor de gas en elektriciteit moeten afschaffen. dit fel gecontresteerde orgaan had wel de bevoegdheid om de prijzen te controleren en deed dat ook. Al was het een nogal ondoorzichtige instelling. Maar mits wat aanpassingen en wat peer transparantie had dit zeer nuttig werk geleverd zoals dat trouwens in het verleden het geval is geweest, al weten we ook dat velen het hier nier met ons eens zullen zijn. Maar die moeten onze eerdere bijdrage hierover maar eens lezen.
Nu het werd afgeschaft dank zij de voorbeeldige samenwerking van de groenen en de rooien maar niets belet om de CREG met deze bevoegdheid opnieuw te belasten. De energieregulator heeft deze prijscontrole immers nooit als bevoegdheid gekregen en meer dan eens is ze daarom teruggefloeten geweest wanneer ze wat commentaar durfde geven over de tarieven door de producenten gesteund door rechtbanken die natuurlijk de wet moeten laten naleven. En in die wet staat die bevoegdheid niet ingeschreven. Dus is onze conclusie, hou op met dat hypocriet gedoe van Far-West-praktijken en verander de wet. lGeef de CREG de bevoegdheid om de energieprijzen te controleren en eventueel sancties te nemen. De consument zal er alleen maar beter van worden...

Huiszoeking bij Electrabel en SPE

BRUSSEL - Electrabel en SPE zijn gisteren het doelwit geworden van de grootste huiszoekingsactie ooit van de Belgische mededingingsautoriteit.

De mededingingsautoriteit heeft vijftig onderzoekers gestuurd naar de twee elektriciteitbedrijven om bewijzen te zoeken. Een groep van 35 klopte aan bij Electrabel, de rest bij SPE.

Het doel is na te gaan of de aanbieders van elektriciteit op groothandelsniveau op een kunstmatige manier de prijzen hoog houden om zo de concurrentie op de energiemarkt af te blokken. Dat zou onder meer gebeuren door het inhouden van productiecapaciteit.

Electrabel en SPE zijn de twee grote elektriciteitsproducenten van ons land. De twee samen controleren ruim tachtig procent van de Belgische elektriciteitscentrales. De twee bedrijven deelden gisteren mee dat ze hun volledige medewerking aan het onderzoek verlenen.

Bij het Auditoraat voor de Mededinging sloten ze gisteren niet uit dat de huiszoekingen meerdere dagen in beslag zullen nemen. Volgens woordvoerder Bart Stulens mag niet verwacht worden dat de Belgische mededingingsautoriteit op korte termijn de resultaten van haar onderzoek zal neerleggen. ‘Gezien de complexiteit van het dossier zullen pas in de loop van 2010 conclusies getrokken kunnen worden', verklaarde hij gisteren.

Dat het Auditoraat voor de Mededinging de grote middelen inzet, is volgens Stulens perfect verklaarbaar: ‘Energie is een absolute prioriteit voor ons.' De bevoegde minister, Vincent Van Quickenborne, heeft het over een onderzoek van ‘cruciaal belang'.

De huiszoekingen komen niet echt onverwacht. Half juni liet de federale minister van Energie weten dat de Belgische mededingingsautoriteit een onderzoek moest voeren naar de vervalsing van de groothandelsprijzen voor elektriciteit. Dat gebeurde nadat de Belgische energieregulator, de Creg, had uitgepakt met een rapport over de prijsschommelingen op de Belgische groothandelsmarkt voor elektriciteit. De Creg linkte toen prijspieken aan de wijze waarop Electrabel zijn elektriciteitspark liet draaien of niet liet draaien.

Electrabel en zijn topman Jean-Pierre Hansen reageerden furieus op de bevindingen van de energieregulator. Temeer omdat de grootste elektriciteitsgroep van ons land meteen aangewreven werd dat ze de elektriciteitsprijs had gemanipuleerd en dat dit zeker 100 miljoen euro extrawinsten had opgeleverd. Hansen drong toen zelf aan op een onderzoek door de rechtbank of de Raad voor de Mededinging.

De mededingingsautoriteit zelf wijst erop dat ze niet gewacht heeft op het rapport van de Creg. Electrabel kreeg gisteren te horen dat het onderzoek voortvloeit uit een klacht die ingediend werd op 28 januari van dit jaar. Het gaat wellicht om een klacht van de kleine onafhankelijke energieleverancier Lampiris.

Some people say she had information about the Italian military selling guns to the warlords.

Some say she had information about the torture and killing of Somali prisoners by Italian soldiers.

And now some people say she had information about al Qaeda in Somalia.

All I know is this:

Forty five minutes after I first met Ilaria Alpi, she was dead, slumped in a puddle of her own blood in the back seat of a white Toyota pickup truck.



We had spoken briefly inside the high-walled compound of the Sahafi hotel, the journalists' hotel, in Mogadishu. She told me she was a television correspondent from Italy and had just returned from a town in northern Somalia, a place she heard I knew well. But Ilaria had no need to introduce herself; I already knew of her. She stood out in Mogadishu. She was a small, serious 32-year old Italian reporter who fearlessly stuck her microphone in the faces of UN officials, military commanders and Somali warlords. While a lot of TV reporters spent more time fixing their hair than studying the country, Ilaria made her name by working the streets, using fluent Arabic and stubborn resolve to dig into places that few other journalists saw.

Ilaria asked me if I'd have a free moment to talk that evening. She seemed shy, almost apologetic about imposing on my time. I assured her that it was no problem, and that I'd be willing to talk with her whenever she wanted, even immediately if it would help. She couldn't talk right then, she said. There was someplace she needed to be.

I collected my crew, the driver and two armed bodyguards who shadowed me every moment I was outside the hotel compound, and we headed off to the northern part of the city. Ilaria and her cameraman, Miran Hrovatin, climbed into their Toyota pickup with a driver and gunman and also drove north. It was a quiet Sunday afternoon in Somalia, just after lunch when a blanket of midday heat keeps the sandy rubble-strewn streets of Mogadishu empty and menacing. I set off on my rounds, trolling for stories and information. To that end I dropped in at the home of a Somali friend, a young former guerrilla fighter who from time to time passed along some valuable intelligence. On this particular day he didn't have much to offer. His sister served us tea in the shade and we were relaxing, talking about nothing of consequence, when we heard the short bursts of gunfire. We kept silent for a moment, listening to hear if the shooting was going to escalate. But nothing more happened, and we didn't give it another thought.

It wasn't until early evening when I returned to the Sahafi that I heard the news. "It's Ilaria," my friend Carlos Mavroleon said to me as I walked into the lobby. "They've killed Ilaria."

Carlos, who was working as a cameraman for ABC News, had run to the scene as soon as he heard the gunfire. He learned that a Land Rover full of gunmen had cut in front of Ilaria's pickup in North Mogadishu. Someone started shooting. Their driver and bodyguard were unhurt. Carlos took me upstairs to his hotel room and showed me what he had videotaped at the scene. In the video, the bodies are being removed from the pickup truck and placed in a Land Cruiser owned by an Italian resident of Mogadishu, a man who was known to everyone by his first name, Giancarlo. Ilaria is wearing bright orange pants, and Birkenstock sandals. Her loose white shirt is stained with blood, and there is more blood smeared across her forehead and on her blond hair. In the back of the Land Cruiser Ilaria looks like she is sleeping. One of the Somalis who helped move the bodies hands Ilaria's notebook and a pair of two-way radios to Giancarlo. And Giancarlo says simply, that Ilaria and Miran were somewhere they shouldn't have been.

I knew what we were going to do later that night. I was used to the ritual by now. We gathered, about ten of us, in someone's hotel room and poured tall glasses of whiskey, the sickened pallor of our faces exaggerated by the wash of fluorescent light reflected off chalky white walls. We sat until morning exchanging bits of information that we hoped would add up to a reason, some determination about why our colleagues were dead. It was important that each of us believe that reasons existed. Ascribing a logic to death meant that measures could be taken to avoid it. We could convince ourselves that hiring the right security guards, driving on the right roads at the right times and saying the right things would keep us safe. But we knew better.

There was no mystery to death here. We spent our days with hired bodyguards travelling bombed out streets jammed with technicals - armed vehicles carrying hungry, glassy-eyed teenagers with automatic weapons. Any one of those kids could turn and pop you in a second, as easily as he could spit. Not even the walls of the hotel provided real protection. One reporter was shot in the leg during lunch. Another stepped from the shower just as a round sailed through the concrete outer wall and exploded through the porcelain stall.

But that didn't stop us from looking for reasons behind Ilaria's death. There was talk that she may have once fired a bodyguard who had then taken revenge. That sort of thing happened a lot in Mogadishu. There was no faster way to die here than to interfere with someone's livelihood. One of us even suggested that Ilaria could have uncovered some information that threatened one of the warlords or other powerful people. That was a nice thought. Given the choice, any of us would have picked assassination by evil international gunrunners to death at the whim of a bored teenager.

I participated in the discussion without ever believing her death was more than really bad luck. Ilaria wasn't the first journalist to die in Somalia and she wouldn't be the last. And after 15 years of covering stories in Africa I had lost what little patience I had for conspiracy theories. All it takes is a few missing pieces of information or inconsistencies in a large and complex story for someone to start talking about the CIA or Mossad or the hand of unnamed international forces.

Certainly there were mysteries surrounding Ilaria's death: Several of her notebooks disappeared after her body was loaded on a plane for Rome. A 35mm camera she had with her was also missing. But that alone was no reason to believe in a conspiracy. Things do get misplaced. Every loose end can't be tied up. And, after all, this was Somalia.
Somalia had been in a state of anarchy since 1991 when its dictator of two decades, Mohamed Siad Barre, was defeated by rebel armies led by Mohamed Farah Aidid. When Aidid's troops poured into Mogadishu, Barre's armies retreated south and west from Mogadishu toward the Kenya border. As they fled, they destroyed the country's food supply, burning fields and looting grain stores to slow the pursuit of Aidid's rebels. By the time they were done, there wasn't much food left in southern Somalia. The capital, Mogadishu, was reduced to rubble, and the country's grain producing area was overrun by unruly militias. The aid groups who came in from the West couldn't operate, and starvation began to spread. In the summer of 1992, people in Europe and the U.S. began seeing the pictures of starving Somali kids that resulted in Operation Restore Hope and the U.S. Marines landing on the beaches of Mogadishu in December of 1992.

By January of 1993, a multinational task force had pretty much put an end to what was left of the famine. But then they found themselves facing a much more difficult problem: the heavily armed and uncompromising militias of Somalia's warlords. A confrontation was inevitable. In June of 1993, the famous and ill-fated hunt for Aidid began. It ended four months later, on October 3, 1993, when 18 Americans were killed and the body of one of them was videotaped as it was hog-tied and dragged through the dusty streets of Mogadishu.

By March of 1994 Restore Hope was over. Western peacekeeping troops were packing their bags and leaving the unfinished job in the hands of darker-skinned soldiers from Malaysia, India, and Pakistan. The press came in to cover that retreat. Ilaria Alpi was among them. She was there to report on the withdrawal of Italian troops when she died on March 21, 1994.

Over the next few years I thought about Ilaria from time to time. Usually it was during a trip to Mogadishu when I would stop at the place on the road where she was killed. There were many such places scattered throughout Mogadishu, where friends and colleagues had lost their lives: the spot where photographer Dan Eldon was beaten to death by an angry mob; the intersection where Kai Lincoln, a young U.N. worker, was gunned down by bandits. I had only met Ilaria once, and briefly, and yet her death had stuck with me. I pointed out the spot where she died to several people who had never known her. In my mind I would trace the route of her pick-up down the hill. I would see the point where the blue Land Rover cut them off on the road, where the gunmen piled out. I almost thought I could see the tire marks left over when Ilaria's driver slammed the truck into reverse trying to back away.

In the Summer of 1997, I saw wire reports about photographs that were published in the Italian magazine Panorama. One photo shows Italian soldiers attaching electrodes to the testicles of a Somali prisoner who is tied to the ground. In another, a Somali woman is being raped with the end of a flare gun. The photos were taken by the Italian soldiers themselves, peacekeepers recording their triumph for posterity.

I began following the story. The publication of the photos forced the Italian government to launch an inquiry. And that inquiry led to a diary kept by an Italian policeman stationed in Somalia. (In Italy the police overlap with the military.) The policeman, Francisco Aloi, wrote of spending time with a young television journalist named Ilaria Alpi. He wrote about how Ilaria had discovered some of the abuses and had gone to the Italian commander in Somalia, General Bruno Loi and told him that she would expose the abuses if he didn't do something about it. The general reportedly told Ilaria that it was only a few isolated cases that he would investigate and pursue. Months later, as the last Italian troops were leaving Somalia, the crimes remained uninvestigated and perpetrators remained unpunished. And Ilaria was preparing to do her final report from Somalia.

I learned that the controversy about Ilaria's death had never quite died in Italy. In fact, the few loose ends that I was aware of had unraveled into a vast tangle of conspiracy theories. According to various scenarios, Ilaria was murdered because she had information about arms trafficking, toxic waste dumping, or the selling of Somali children into slavery. All of these conspiracy theories contained a common element: While the men who pulled the triggers were Somali, the people who paid them, the ones who wanted Ilaria dead, were Italian.

Chief among the conspiracy theorists was Georgio Alpi, Ilaria's father, a well-known doctor in Rome, and member of Italy's communist party. In the four years since Ilaria's death, he had appeared on Italian television, lobbied journalists, and had done everything he possibly could to keep stories of Ilaria alive.

In January of 1998, in an attempt to mollify Georgio Alpi and close the book on the rampant rumors, a group of Somalis were escorted to Rome to give depositions against soldiers who were accused of torture. And when one of those Somalis - a young man named Hashi Omar Hassan - showed up at the police station he was arrested, charged with Ilaria's murder. It appeared to me that the Italians had taken their two outstanding issues in Somalia and tied them up in one neat package which they were prepared to flush away. The complete saga was reduced to this: The young Somali, Hashi Omar Hassan, had been tortured by Italian troops and then gotten his revenge by participating in the killing an Italian reporter. End of story.

But none of that made much sense to me or fit with the facts I had collected right after Ilaria's killing or what I knew about Somalia. It looked very much like a coverup and, as in other well-known cases, the coverup was the most powerful explicit evidence of the existence of the crime. And so I went to Rome to take a closer look at the investigation and several things became clear to me for the first time: Ilaria's death was not an act of random violence on a Mogadishu street. Somebody wanted her dead. And she wasn't killed in midst of a wild gun battle. She was assassinated, killed by a single shot fired from point blank into the back of her head.

There are many details about his daughter's death that four years later continue to keep Georgio Alpi awake at night. There is the fact that no investigation was ever done at the crime scene. And then there was the Italian military's refusal to rush medical assistance to Ilaria after she was shot. And it breaks his heart that incompetent forensic work has required that her body be exhumed, twice. But the thing that angers him most is that he and his wife Luciana never really said goodbye to Ilaria. When her body arrived back in Rome the family was told that during the ambush she had been raked with automatic weapons fire. They decided they didn't want to see her like that. So they never viewed the body of their only child, never had the chance for that important rite of closure. It was only after she was buried that they learned the truth, learned that there was only a single, neat bullet hole in the back of Ilaria's head.

Why, her parents want to know, did the Italian government lie to them? There is no satisfactory answer for them other than the obvious one: The government and the military are covering up the real reasons for their daughter's death.

Georgio and Luciana sit side by side on the couch in their apartment on the outskirts of Rome. They hold hands, and smoke cigarettes. Georgio is a small, wiry 74 year-old with thick bushy eyebrows jet black hair and an intense chiseled face. His lower lip quivers uncontrollably when he starts telling stories about Ilaria. Luciana, 65, has short blonde hair and a solid robust looking about her. Her voice is deep and gravelly.

Georgio and Luciana live in the apartment where Ilaria grew up. Her room is more or less as she left it, even though she'd moved out, gone to college, lived in Egypt for two and a half years and then gotten her own apartment in with a friend in Rome after being hired by RAI, the Italian state broadcasting corporation. There are photos of her everywhere. Several show her wearing a red, hooded jacket, her blonde hair tied in a pony tail. She clutches a microphone and peers into the camera. The reports she sent back were saved on videotapes stacked beside the Alpis' television.

Her parents admit that they may have been overprotective of Ilaria, who as a child was quiet and fragile. They speculate that Ilaria set out for remote areas of the world in part to get away from their influcence, to proclaim her independence. Georgio tells about how young Ilaria was too shy to even ask for what she wanted in Rome's coffee bars. "Papa, tell them I want a glass of water," she would say. When she was 13, Ilaria worked on her school newspaper and decided she wanted to be a journalist. Georgio bought her a present, a small tape recorder. As he tells this story he begins to sob uncontrollably. Luciana's eyes turn red, and she comforts her husband. Shy Ilaria took the tape recorder and went out into the neighborhood interviewing news vendors about their business. It was a pattern that seemed to hold in her adult life. She struck those who met her as sweet and reserved. But as soon as she had a microphone and camera with her she was aggressive, professional, and self assured. "So self assured that she didn't have to be a bitch," was how one senior military official compared her to other female reporters.

While many television reporters saw themselves as the stars of their shows, Ilaria once complained to her editor in Rome that she wanted to spend less time on camera. "Why should the viewers be looking at me when I could be showing them another ten seconds of Somalia?"

Her parents and I watch some video of Ilaria, particularly her last interview with a clan leader named Boqor (King) Musa. Ilaria is interviewing Musa in the town of Bosasso, a relatively peaceful port 1,500 miles north of Mogadishu on the Gulf of Aden. Musa has a thick gray beard and a lazy eye. Everyone knows him affectionately by his nickname, King Kong.

Georgio Alpi turns to me and asks if I know King Kong, and if so, what I think of him. I tell him that the King is a decent fellow who spends his days at a hotel in Bosasso watching CNN. In these days of warlords he doesn't wield a lot of power, but he knows what's going on. Ilaria's discussion with King Kong is fairly mundane. They're talking about development projects and the like. Then she brings up the subject of arms trafficking. King Kong hesitates, and Ilaria tells Miran to shut the camera off. With the camera pointing away, but the sound still rolling you can hear King Kong speak about things that "came from Rome, Brescia, or Torino." Brescia is the arms manufacturing center of Italy. Then you can hear the final words on the tape, from King Kong: "those people have much power, contacts". Georgio thinks the answer to his daughter's death is in that interview.

The one and only time I met Ilaria, she had wanted to talk to me about Bosasso, and about King Kong. Something had disturbed her that day. What was she after? What did she want to know? The truth is, had I talked to Ilaria that night at The Sahafi Hotel, there wouldn't have been much I could tell her. But I might have found it curious that an Italian journalist in Mogadishu to cover the departure of Italian troops would have found an important reason to travel to Bosasso where there weren't any Italians.

Ilaria was on her fifth trip to Somalia. Miran was there for the first time. The two of them caught a UN flight to Bosasso, and apparently didn't tell anybody they were going. Several days after they left, Italian journalists began asking the staff of the Sahafi hotel where she was. Even the Italian ambassador to Somalia showed up at the Sahafi wearing a flak jacket and helmet with an armed escort inquiring about her whereabouts. The owner of the Sahafi, Mohamed Jirdeh Hussein, found it curious that the ambassador would risk being in the streets at that time at all. The hotel staff informed the ambassador that Ilaria had gone to Bosasso.

She was due to arrive back in Mogadishu on Saturday, March 20. The Italian military actually sent a few men to meet her plane and escort her from the airfield. They were going to advise her to spend the night on the Italian naval vessel, the Garibaldi, which was anchored off of Mogadishu. (I smiled when I first heard this. In a million years, even if we were under bombardment, the U.S. military would never send an escort for a journalist. And most U.S. journalists wouldn't have accepted one. We kept our distance from the military, maintained our independence. But the Italians felt they were all in it together.) Her plane arrived a day late, on Sunday at about 12:30. Though her escorts could easily have found out that the flight had been rescheduled, no one was there to meet her. So she and Miran caught a lift to the Sahafi where they checked in and had lunch. It was just after lunch when she and I spoke.

Ilaria then phoned RAI in Rome and asked for some satellite time at around 7:00 p.m. so she could feed some video back. She said she had some good footage. "We can speak about the story of the day later." The producer remembers that Ilaria had something she really wanted to do. "I'm in a hurry," she said. She then phoned her mother one last time.

At about 2:45 Ilaria and Miran left the Sahafi, heading across the Green Line into North Mogadishu to the Amana Hotel where some Italian journalists sometimes stayed. During the peacekeeping operation a feud had opened up between the Italian contingent on one side and the U.S. and UN on the other. In short, the Italians felt that they had been dissed in Somalia. This was, after all, their former colony. They had a 100-year relationship with the place. But Operation Restore Hope was at its core an American show. The top UN official was a former U.S. Navy Admiral. The UN headquarters was located in the former U.S. embassy compound south of the Green Line in territory that was controlled by warlord Mohamed Farah Aidid. The Italians sequestered themselves north of the Green Line in the area where the former Italian Embassy was and which was controlled by warlord Ali Mahdi Mohamed. There they pouted and sulked and took more than a little delight in the problems that the Americans later encountered in the ill-fated hunt for Aidid.

The Italian peacekeeping strategy in Somalia - as it had been in Lebanon before -was to make friends with everyone and stay out of the line of fire. I recall standing with some Italian soldiers one day by the Green Line, surrounded by rubble and barbed wire. The Italian commander warned me to move on because, he said, there had been a sniper in one of the buildings who was shooting at people. Why aren't you afraid, I asked him. We have an arrangement with him, the commander said. So the Italians made their separate peace with the forces that controlled the North.

Part of that dynamic involved the man everyone knew as Giancarlo. Giancarlo Marocchino, an Italian citizen and 50-something trucking magnate from Genoa who had made his home in Mogadishu since 1984 when he went into exile after being indicted for tax evasion. He married a Somali woman from the clan that now controls north Mogadishu, and settled in. If Giancarlo were to set foot in Italy today he would be arrested, but in north Mogadishu he became a good friend to, and important source of intelligence for, the Italian military. The U.S. military, on the other hand, once, briefly, had him thrown out of Somalia. U.S. intelligence was sure that Giancarlo was getting rich selling guns to the warlords. At one point an American intelligence officer suspected that weapons confiscated by the Italian military were sold to Giancarlo who then reconditioned them and sold them back on the streets.

During the 1980s, Italy's socialists under Prime Minister Bettino Craxi seemingly turned their entire government apparatus into a huge money laundering operation - and their former colony of Somalia played a huge role in that corruption. Trillions of lire were sent to the impoverished country as "aid" and recycled back into the pockets of Italian government officials and their cronies. (Some of this corruption came to light in 1989 when Mohamed Farah Aidid - not yet a world famous warlord - sued Craxi for 50 million lire that he says he was promised as part of a kickback scheme.) The biggest scam aid projects in Somalia were in the northeast, near Bosasso. One of those projects involved the construction a first-rate highway built through the desert linking Bosasso to Somalia's main road. One of the main beneficiaries of that road, and of the slush fund around the project, was the man who was very active in the area's trucking business, Giancarlo Marocchino.

During Operation Restore Hope, Giancarlo became a good friend to the Italian journalists, many of whom stayed in his home and paid for his protection. Giancarlo provided them with meals, cars, drivers, and bodyguards. Several of the Italian journalists, however, refused to stay with him. One of those journalists was Ilaria Alpi. She thought he was a gun-running sleaze bag.

So Ilaria and Miran headed north over the Green Line in their white pickup truck. Their driver was named Ali and their bodyguard was a young kid named Mahamoud. In retrospect, it clearly wasn't advisable to be traveling around Mogadishu with only one gunman. At that time I was traveling with two, some days with more. I rode in a sedan and had a pickup truck full of gunners following me. Other journalists did likewise. We realized that the pullout of the Western troops was making Somalis nervous.

While the public in Europe and the U.S. saw Operation Restore Hope as a grand charitable gesture, the Somalis saw the thing in terms of money. The UN, the charities and the press were pumping hundreds of thousands of dollars a day, cash, American dollars, into the Mogadishu economy. The foreigners living in Somalia had hired guards and drivers and rented houses and cars for astronomical amounts of money. Each journalist had an entire crew on his payroll. In addition, the presence of the peacekeeping troops meant that Somali businessmen could continue to operate. Somalia under the protection of the UN, but without governmental authority, had become a haven for smugglers. Cigarettes, for example were imported tax free (who was going to collect?) and sent across the borders to Kenya and Ethiopia.

And foreign boats came to fish Somalia's waters. Sometimes warlords were able to extract tribute from them. Sometimes they just seized the ships. At the time Ilaria was in Bosasso, the local militia had hijacked several fishing ships that were being held for ransom just off the coast. One ship in particular had attracted some attention at that time. It was a ship that had been donated as Italian aid to the Somalis. It had an Italian captain, two Italian officers and a Somali crew. Kidnapping and hijacking were business as usual in Somalia.

With the peacekeepers pulling out Somalis were aware that everything could change. And we were aware that the end of the gravy train might be the beginning of trouble.

People who knew Ilaria well said that she might have become too comfortable in Mogadishu. She was well known and popular among the Somali people, especially the women who she spent time with and whose causes she championed. They had given her a nickname (everyone in Somalia had a nickname), which translated to "little smile." One of those causes was female genital mutilation. Somali girls when they reach puberty undergo the rite of infibulation. Their labia are sliced off and their vaginas are sewn up until their wedding night when their husbands will crack the seal that guarantees he's getting a virgin. As horrible as this is, few members of the highly cynical Africa journalists corps thought it worth reporting on. The custom is common enough in Africa and it's not news. It was news to Ilaria, who was outraged and was naive enough, or idealistic enough, to think that journalism could somehow make life better.

At about 3 p.m. Ilaria and Miran arrived at the Amana hotel where the correspondent for the Italian news agency (ANSA) was staying even though she knew he wouldn't be there. The Amana is located on a hillside on a quiet street near the former Italian embassy. Ali and Mohamoud turned the truck around so it was pointing back down the hill where they had come from. Across the street from the hotel was tea stall, which was just a few benches in the shade where a woman boiled tea on an open fire. A group of men in a blue Land Rover pulled up, parked, and began drinking tea. They never got to finish it.

Only minutes after they went in, Ilaria and Miran walked out of the hotel, climbed into their pickup and started down the hill. The seven men from the Land Rover, quickly put their tea down, piled back into their vehicle and overtook the pickup, cutting them off at the bottom of the hill where the street intersected with a main road. Two men jumped out of the Land Cruiser. And the shooting began.

That point is where all agreement about what happened ends and where contradictory stories, some from the same witnesses begin.

Wij hebben vreselijk nieuws voor al onze lezertjes die tijdens hun vakantie hun pootjes hebben gebaad in het azuurblauwe water van de Middelandse Zee. Hopelijk is dit geluk niet te beurt gevallen aan een meerderheid van onze lezertjes want anders kunnen we d'r maar beter onmiddellijk mee ophouden. In elk geval raden we jullie aan vanaf nu ofwel naar Hofstade Plage, De Beekse Bergen, Plopsaland, Legoland, Scheveningen, Blankenberge te gaan of thuis te blijven en naar de Kampioenen te kijken. Zet geen teen meer in dat vreselijke water dat Middelandse Zee noemt en zeker niet in de buurt van Italië maar waarschijnlijk overal. Blijf daar weg! Plant je tentharingen nog liever op een Waals gifstort, desnoods op de Hoge Maey maar blijf weg van de blauwe vuinisbelt met de fraaie plaatjes. Lees met ons mee want dit is spannender dan The Godfather ! Merk vooral ook de rol op van de Italiaanse authoriteiten.... Het gaat niet over de onderzeeër Kursk maar over het schip de Cunsky...en vele anderen waarschijnlijk. Of hoe winstbejag een bepaalde mensensoort zo gek maakt dat ze er geen graten in zien hun medemensen te laten creperen samen met de rest van de natuur. Dat noemt zich dan rationeel denkende wezens....
We beginnen in Italië maar we bezoeken eveneens zeer exotische plekken maar dat is voor later..

Rome, 14 sept. Met de vondst van een gezonken koopvaardijschip heeft de Italiaanse justitie mogelijk een doorbraak gerealiseerd in een al jarenlang lopend onderzoek.

Het vermoeden is dat de maffia in de jaren tachtig en negentig tientallen schepen met radioactief en giftig afval in de Middellandse Zee heeft laten zinken.

Afgelopen zaterdag werd het schip de Cunsky 300 kilometer ten zuiden van Napels teruggevonden op een diepte van 487 meter onder de zeespiegel. Aan boord 120 vaten, waarvan spoedig de inhoud wordt geanalyseerd.

Al in de jaren negentig deed justitie onderzoek naar de dumpingen. Officier van Justitie Francesco Neri werd toen van hoger hand gedwongen zijn werk te staken, omdat hij er niet in slaagde de afgezonken schepen terug te vinden.

„Ik had alles verzameld, maar beschikte niet over de economische en technische middelen om de schepen te zoeken”, zegt hij vandaag in la Repubblica. „We werkten in een heel moeilijk klimaat. Men zei dat ik met een heksenjacht bezig was.” Neri deed onderzoek naar het verdwijnen van 180 schepen. Zijn belangrijkste medewerker overleed op 38-jarige leeftijd aan „een hartinfarct”, nadat hij een kopje koffie had gedronken in een wegrestaurant. Neri gaat er van uit dat de Calabrese maffia, de ‘ndranghetta, de schepen in opdracht van derden liet zinken.

Het openbaar ministerie van Paola, in het Zuid-Italiaanse Calabrië, heropende in 2004 de zoektocht naar de vaten, nadat een spijtoptant van de ‘ndrangheta begon te praten. Deze Francesco Fonti zegt het op zijn aanwijzingen teruggevonden schip Cunsky te hebben afgezonken.

Milieuorganisatie Legambiente eist dat de gearchiveerde juridische onderzoeken naar de dumpingen worden heropend. Ook wil zij dat er een crisisteam wordt gevormd dat de ernst van de vervuilingen en de gevolgen voor de volksgezondheid in kaart brengt.

International Eco-Mafia and an Ecological Catastrophe

The Nuclear Dump in the Mediterranean Sea

Now being overshadowed by the deaths of 6 Italian soldiers in the growingly unpopular war in Afghanistan, another deadly and sinister Tragedy is brewing. In the beckoning blue waters of the Mediterranean Sea that surround the Italian Peninsula and its islands, and which laps at the coasts of 22 countries in Africa, Europe, the Middle East and Asia, a hidden legacy of the Sea being used as a disposal site for radioactive and other toxic wastes for over 20 years is beginning to come to light. What some inside the halls of government are calling an international catastrophe, runs the risk of being swept under the table once again by an Italian Government that has been colluding and embroiled in this ecological and public health disaster from its beginnings.

Dozens of ships, reportedly carrying cargos of what could be thousands of barrels of radioactive and toxic wastes have been intentionally sunk off the shores of Italy, Spain, Greece and as far away as Africa and Asia, by the International Ecomafia led by Calabria’s ‘Ndrangheta organized crime syndicate. This has taken place for over twenty years and insiders in the Italian government and secret service have been involved in covering it up. The first of these ships to be found, thought to be called the Cunsky, has been photographed by a robot off the coast of Cetraro, a medium sized town on the Tyrrheinan coast of Calabria. Cancerous tumors and thyroid problems are highly prevalent here and a growing epidemic all along the coasts of the Mediterranean Sea. Certraro is a town known for its port by tourists all over the world. Fish caught by the hundreds of fishemen that make their livelihoods there are eaten throughout Italy and sold on the International market.

The setting for this story is putting the spotlight on the south of Italy and the regions of Calabria in the toe of the boot, Basilicata above Calabria, Puglia in the heel, but also Greece and Spain with repercussions for the entire Mediterranean basin. The facts of this unfolding disaster have been documented by Greenpeace and Italy’s leading environmental organization Legambiente dating back to the late 90’s. Greenpeace has worked to trace the trail of large Cargo Ships that have disappeared from international circulation. Between 32 and 41 such ships are thought to have been sunk in international waters between Italy, Greece and Spain, but mostly along the Italian coastlines. Then, in 2005, a mafia “pentito” (one who repents) named Franceso Fonti testified of his involvement in the sinking of three specific ships called the Cunsky, off Cetraro, the Yvonne A off the coast of Maratea in Basilicata, and the Voriais Sporadais, said to be off the coast of Metaponto in Basilicata on the Ionian Sea. All are international tourist destinations with large fishing industries.

Last week a robot was sent down into the depths 11 kilometers off the coast of Cetraro. There, the robot shot photos of the ship thought to be the Cunsky, confirming the story of the ‘Ndrangheta “pentito” and striking a chord of alarm throughout Italy and the world. In the photos drums like those used to transport and store radioactive and toxic wastes can be distinguished.

Reports of up to 41 boats have now surfaced in the international media. It is hoped that many of the barrels are still intact, but no one knows for sure and it is still unclear what they contain. Traces of Mercury and Cesnium 137 have recently been found near the town of Amantea in Calabria further south of Cetraro by about 50 kilometers. Cesnium 137 is a radioactive byproduct of fission reactions that is highly soluble in water and highly toxic, with a half-life of 30 years. This contamination is believed to have come from another ship called the Jolly Rosso that beached along the Calabrian shore in 1990. The cargo of the Jolly Rosso was illegally dumped near Amantea on a hill along the Oliva River. Amantea is a hotspot for tumors and ground temperature around the contaminated area is said to be six degrees warmer than normal. The population is demanding the truth and government action.

International cooperation is needed in order to find and remove the sunken ships from the seabed. This will have to be an enormous and unprecedented undertaking needing close monitoring by international organizations, the European Union and the United Nations. For now Japan has offered its assistance as a large sector of their tuna fishing is done in the Mediterranean between the coast of Spain and Sardinia. A very strong concern here is that past and current government ties to the International Ecomafia may hinder efforts to fully investigate the scope of this calamity or to swiftly initiate attempts to contain the damage already caused. According to the “pentito” Fonti, he was in contact with agents from the Italian secret service, SISMI, and government officials in 1992 when he was involved in the sinking of these ships.

Author and Italian parliament member Leoluca Orlando, stopping short of blaming the government outright or any specific government officials, said that people in the "political system" aided the criminal network.

"Can you imagine that it is possible to happen without persons inside the system, inside the political system, inside the bureaucracy, inside the state, not being connected with these criminals?" he said. "I am sure that inside the official system there are friends, there are persons who have protected this form of criminality."

Francesco Neri, an official working with the Calabian anti-mafia directorate, said that it is unclear who wanted to dispose of these wastes, but that this would be part of their investigation. The pentito Fonti stated that wastes that he dealt with came from Norway, France, Germany and the United States.

Ilaria Alpi was a Journalist who was following the trail of arms and toxic garbage trafficking from Italy to Somalia. She worked for Italian public television station Rai. In 1994 she and her camera man Miran Hrovatin were gunned down and killed in Mogadishu under mysterious circumstances. Many here believe, including the Mafia pentito Fonti, that she was killed because she learned too much about the collusion between the Mafia and Italian military.

I have lived in Calabria for almost two years with my wife and beautiful 14 month baby Gaia Valmaree, who was named in honor of both our mother Earth and my own mother. Upon our return from a visit to the toxic cities of Toledo and Detroit, we were alarmed and shocked to learn that the Tyrrhenian sea, which Gaia has been bathing in since her birth, has been intentionally poisoned with radioactive and other highly toxic wastes for over twenty years. How shocked and dismayed we were to discover that government officials have known about it all along. And how enraged we are that a journalist has been killed, possibly for trying to reveal the truth about the disposal of waste by the international Ecomafia and their colluding government and corporate interests.

Mafia turncoat says “nuclear dump” funds deposited in Malta

An Italian mafia turncoat testifying about the dumping of nuclear and toxic waste in the Mediterranean Sea said that Malta was one of three countries where the criminal organisation deposited money coming from illegal operations.

A former member of the Calabrian Mafia (ndrangheta), Francesco Fonti admitted in front of an Italian judge that the criminal organisation had sunk ships carrying nuclear and toxic waste in the Mediterranean Sea in the 1980s and 1990s.

The accusations are not new but in the past judges had always archived suspect cases because no proof was ever provided of the sunken ships. However, this changed last Saturday when a submersible robot discovered the wreck of a ship that went down in 1992 with 120 drums of toxic waste. The drums were also visible at a depth of 487 metres.

Mr Fonti admitted he had sunk the cargo ship Cunsky off the Cosenza coast after loading its bow with explosives.

In an interview yesterday on Rainews 24, Mr Fonti said the Mafia was paid good money for running the dumping operation. He alleged that the money than found its way to Switzerland, Cyprus and Malta, without elaborating.

Italian environment group Legambiente said there were between 40 and 100 suspect cases between 1985 and 1995 of ships laden with nuclear and toxic waste that mysteriously sunk in the Mediterranean’s deepest points. In each of the cases, the ships never launched a May-day signal and the crew mysteriously disappeared.

The more notable cases include the Maltese-registered cargo vessel Anni, which sank in 1989 off the Ravenna coast in international waters.

Other ships include the Nikos I that vanished in 1985 during a voyage that started in La Spezia for Lome in Togo and sank somewhere between Lebanon and Greece.

Another ship, the Mikigan, sank in the Tyrrhenian Sea in 1986 while carrying suspect cargo.

However, it was the sinking of the Rigel in September 1987 that ignited Legambiente’s suspicions and which led to the first judicial investigation into the matter.

The recent discovery of toxic cargo in the depths of the Mediterranean Sea is expected to prompt a re-opening of archived judicial cases.

“Re-opening the cases was important to establish who was responsible for the illegal dumping and to monitor the sea contamination, which could be dangerous for human health and the ecosystems,” Nuccio Barilla of Legambiente Calabria was quoted as saying.

GREENPEACE URGES BEIRUT GOVERNMENT:
ASK ITALY TO RETURN ALL TOXIC WASTE STILL IN LEBANON

Beirut, Lebanon, May 12, 1995 (GP)-Greenpeace today urged
the Lebanese government to officially ask Italy to return
toxic waste an Italian company dumped in Lebanon in 1987.
Despite promises made by the Italian government in 1988 that
all the wastes would be returned, only a small amount of the
2,411 tons of toxic waste was shipped out of Beirut in
1988/89, while the rest remained in Lebanon's soil and
waters.

"Greenpeace calls upon the Lebanese government to demand that
the Italian government fulfill its 1988 promise and return
all the toxic waste to Italy," Fouad Hamdan, Lebanon
Campaigner for Greenpeace's Mediterranean Office, said at a
press conference in Beirut today.

A day earlier in Larnaca, Cyprus, Greenpeace released a
report which reveals that despite claims by Italy to the
contrary, most of the toxic waste exported from Italy and
dumped in Lebanon in 1987, still lies on Lebanese soil or in
Lebanese waters.

"Authorities were hoping that the scandal would be forgotten
in time," Hamdan said. "But toxic waste does not forget
and we cannot forget. Unless action is taken, the poisons
will continue to threaten the Lebanese environment and
public health."

"Italy must take full responsibility. It has a moral
obligation to organize and finance a safe recovery of the
remaining waste and returning them to Italy for safe
storage. Contaminated land in Lebanon must be
rehabilitated and Lebanese citizens indemnified if
proven victims of the
waste," he said.

The deadly shipment from Italy contained a cocktail of
hazardous chemicals: the explosive substance
nitrocellulose; outdated adhesives, pesticides, solvent
wastes, outdated pharmaceuticals, oil residues and toxic
heavy metals including lead, mercury, arsenic and
cadmium; chlorinated compounds including PCBs. Some of the
barrels contained extremely high concentrations of dioxin.
In 1987, the Italian company "Jelly Wax" shipped about
15,800 barrels and 20 containers full of these highly toxic
wastes to Lebanon. "Jelly Wax" took advantage of the civil
war and the state of anarchy in Lebanon that ended after 15
years in 1990.
The now disbanded right-wing militia "Lebanese Forces"
allowed the transaction and supervised it. The waste
dumping scandal became one of the biggest environmental
scandals of the late 1980's and helped to foster the
creation of the Basel Convention in 1989, an international
treaty designed to control and prohibit "waste tourism", as
well as an agreement in the Mediterranean region to ban
waste trade within the Barcelona Convention.

When the criminal deal became known, a public outrcy in
Lebanon and internationally forced the Italian government to
promise, in 1988, to return all the toxics involved back to
Italy. Greenpeace learnt of four ships which had been sent to
pick up the waste and return it to Italy.

But according to Greenpeace research, only the toxic contents
of 5,500 barrels were loaded in 9,500 new barrels aboard the
ships at Beirut Port in 1988. More than 10,000 barrels and
the contents of many containers remained in Lebanon, dumped
in the Kisrwan mountains or along its shores.

Some of the remaining waste was subsequently used as
fertilizer, pesticide or as so-called raw material to produce
paints or foam mattresses, the report says. Many barrels
were burned in the open air. Others were dumped in the
Kisrwan mountains east of Beirut. Ground waters are
threatened with contamination by buried toxic wastes. In
some cases barrels were emptied and sold to people to store
in them petrol, water or food.

In 1989, Italian officials claimed that all the waste had
been returned on board one ship, the "Jolly Rosso". In
February 1995, the Italian Ambassador in Lebanon, Mr. Carlo
Calia, repeated that claim. However the Greenpeace report
provides extensive evidence which contradicts this claim and
gives details of the fate of the three other mystery ships
which dissappeared, never returning to Italy: the "Vorais
Sporiades", "Cunski" and the "Yvonne".

According to research, the "Yvonne" was probably sunk in
the Mediterranean Sea. The report also names some of the
sites in Lebanon where the toxic waste still lies buried:
Uyun al- Siman, Shan-Nair and Sahel Alma in the Kisrwan
Mountains; Qarantina and Burj Hammud, east of Beirut.

"Rich industrialised countries like Italy bear the
moral, political and legal responsibility to ensure that
their wastes are never exported to poorer nations. If such
export does take place, they must investigate, condemn and
rectify the situation immediately and not hide behind a
veil of professed ignorance," Hamdan said.

In November 1994, Greenpeace activists took samples from
barrels of waste stored at Beirut Port. The barrels had
been found recently in the Kisrwan mountains. The test
results showed that solid waste contained heavy metals,
hydrocarbons from oil residues and chlorinated
substances like HCBD, a highly toxic chemical that causes
neurological damage and damages the kidney, and is a
suspected carcinogen. The origin of this waste could be part
of the Italian dumping scheme.

Waste trade and dumping in the Mediterranean region is
a continuing epedemic. Greenpeace calls on all countries
of the Mediterranean region to adopt without further delay
the waste trade protocol of the Barcelona Convention which
will ban the trade in hazardous wastes from European Union
(EU) countries to non-EU countries.

I Am Barack Obama's Political Prisoner Now

The United States Department of Justice has once again made a mockery of its lofty and pretentious title.

After releasing an original and continuing disciple of death cult leader Charles Manson who attempted to shoot President Gerald Ford, an admitted Croatian terrorist, and another attempted assassin of President Ford under the mandatory 30-year parole law, the U.S. Parole Commission deemed that my release would “promote disrespect for the law.”

If only the federal government would have respected its own laws, not to mention the treaties that are, under the U.S. Constitution, the supreme law of the land, I would never have been convicted nor forced to spend more than half my life in captivity. Not to mention the fact that every law in this country was created without the consent of Native peoples and is applied unequally at our expense. If nothing else, my experience should raise serious questions about the FBI's supposed jurisdiction in Indian Country.

The parole commission's phrase was lifted from soon-to-be former U.S. Attorney Drew Wrigley, who apparently hopes to ride with the FBI cavalry into the office of North Dakota governor. In this Wrigley is following in the footsteps of William Janklow, who built his political career on his reputation as an Indian fighter, moving on up from tribal attorney (and alleged rapist of a Native minor) to state attorney general, South Dakota governor, and U.S. Congressman. Some might recall that Janklow claimed responsibility for dissuading President Clinton from pardoning me before he was convicted of manslaughter. Janklow's historical predecessor, George Armstrong Custer, similarly hoped that a glorious massacre of the Sioux would propel him to the White House, and we all know what happened to him.

Unlike the barbarians that bay for my blood in the corridors of power, however, Native people are true humanitarians who pray for our enemies. Yet we must be realistic enough to organize for our own freedom and equality as nations. We constitute 5% of the population of North Dakota and 10% of South Dakota and we could utilize that influence to promote our own power on the reservations, where our focus should be. If we organized as a voting bloc, we could defeat the entire premise of the competition between the Dakotas as to which is the most racist. In the 1970s we were forced to take up arms to affirm our right to survival and self-defense, but today the war is one of ideas. We must now stand up to armed oppression and colonization with our bodies and our minds. International law is on our side.

Given the complexion of the three recent federal parolees, it might seem that my greatest crime was being Indian. But the truth is that my gravest offense is my innocence. In Iran, political prisoners are occasionally released if they confess to the ridiculous charges on which they are dragged into court, in order to discredit and intimidate them and other like-minded citizens. The FBI and its mouthpieces have suggested the same, as did the parole commission in 1993, when it ruled that my refusal to confess was grounds for denial of parole.

To claim innocence is to suggest that the government is wrong, if not guilty itself. The American judicial system is set up so that the defendant is not punished for the crime itself, but for refusing to accept whatever plea arrangement is offered and for daring to compel the judicial system to grant the accused the right to right to rebut the charges leveled by the state in an actual trial. Such insolence is punished invariably with prosecution requests for the steepest possible sentence, if not an upward departure from sentencing guidelines that are being gradually discarded, along with the possibility of parole.

As much as non-Natives might hate Indians, we are all in the same boat. To attempt to emulate this system in tribal government is pitiful, to say the least.

It was only this year, in the Troy Davis, case, that the U.S. Supreme Court recognized innocence as a legitimate legal defense. Like the witnesses that were coerced into testifying against me, those that testified against Davis renounced their statements, yet Davis was very nearly put to death. I might have been executed myself by now, had not the government of Canada required a waiver of the death penalty as a condition of extradition.

The old order is aptly represented by Supreme Court Justice Antonin Scalia, who stated in his dissenting opinion in the Davis case, “This Court has never held that the Constitution forbids the execution of a convicted defendant who has had a full and fair trial but is later able to convince a habeas court that he is 'actually' innocent. Quite to the contrary, we have repeatedly left that question unresolved, while expressing considerable doubt that any claim based on alleged 'actual innocence' is constitutionally cognizable.”

The esteemed Senator from North Dakota, Byron Dorgan, who is now the chairman of the Senate Committee on Indian Affairs, used much the same reasoning in writing that “our legal system has found Leonard Peltier guilty of the crime for which he was charged. I have reviewed the material from the trial, and I believe the verdict was fair and just.”

It is a bizarre and incomprehensible statement to Natives, as well it should be, that innocence and guilt is a mere legal status, not necessarily rooted in material fact. It is a truism that all political prisoners were convicted of the crimes for which they were charged.

The truth is the government wants me to falsely confess in order to validate a rather sloppy frame-up operation, one whose exposure would open the door to an investigation of the United States' role in training and equipping goon squads to suppress a grassroots movement on Pine Ridge against a puppet dictatorship.

In America, there can by definition be no political prisoners, only those duly judged guilty in a court of law. It is deemed too controversial to even publicly contemplate that the federal government might fabricate and suppress evidence to defeat those deemed political enemies. But it is a demonstrable fact at every stage of my case.

I am Barack Obama's political prisoner now, and I hope and pray that he will adhere to the ideals that impelled him to run for president. But as Obama himself would acknowledge, if we are expecting him to solve our problems, we missed the point of his campaign. Only by organizing in our own communities and pressuring our supposed leaders can we bring about the changes that we all so desperately need. Please support the Leonard Peltier Defense Offense Committee in our effort to hold the United States government to its own words.

I thank you all who have stood by me all these years, but to name anyone would be to exclude many more. We must never lose hope in our struggle for freedom.
