Oproep aan de verenigingen die de petitie ondertekenden
TEGEN DE RICHTLIJN VAN DE SCHAAMTE
DE MOBILISATIE MOET VOORTGAAN !!
Het project van de terugkeer-richtlijn zoals die laatst op 22 mei werd aangepast en aangenomen door de vertegenwoordigers van de Lidstaten is nog alarmerender dan de tekst die door het Europarlement werd geamendeerd en waartegen wij al mobiliseerden in de afgelopen maand september.
Terwijl de punten die onze ongerustheid opwekten blijven voortbestaan stellen wij een verharding van de tekst vast, die namelijk voorziet in:
- Een opsluiting van vreemdelingen gedurende een periode die tot achttien maanden kan bestrijken, alleen voor het feit dat ze de grens zijn overgestoken en in Europa wilden leven.
- De opsluiting en verwijdering van kwetsbare personen (zwangere vrouwen, ouderlingen, slachtoffers van marteling,
) en minderjarigen of zij nu al dan niet begeleid zijn, met misprijzen en disrespect voor de voorrang van het belang van het kind. De laatste versie van deze tekst staat opsluiting en gedwongen uitzetting van alleenstaande minderjarigen toe naar een derde land (een ander land dan het land van herkomst) waar zij noch familie, noch een legale voogd hebben. Bovendien wordt het aan de Staten niet langer opgelegd om een verblijfsvergunning af te leveren voor mensen die aan ernstige ziektes lijden.
- Een systematisering van het verbod voor uitgezette personen om het grondgebied van de EU te betreden gedurende vijf jaar.
- Het terugsturen van vreemdelingen naar landen waar zij slechts doorheen reisden, zonder dat zij enige band hebben met dat land.
Dit project van de richtlijn moet nu ter stemming voorgelegd worden aan het Europees Parlement op 18 juni e.k. In afwachting van deze stemming is het belangrijk dat de mobilisatie voortgaat opdat dit project van de richtlijn wordt verworpen.

CONTRE LA DIRECTIVE DE LA HONTE:
LA MOBILISATION DOIT SE POURSUIVRE
Le projet de directive retour tel qu'il a été dernièrement modifié et adopté par les représentants des Etats membres le 22 mai est encore plus alarmant que le texte amendé par le Parlement Européen en septembre dernier contre lequel nous nous étions mobilisés.
Alors que les points suscitant notre inquiétude sur le premier projet subsistent, on note un durcissement du texte qui prévoit notamment:
- un enfermement des étrangers pouvant atteindre dix-huit mois, pour le seul fait d'avoir franchi des frontières et de vouloir vivre en Europe ;
- la détention et l'éloignement des personnes vulnérables (femmes enceintes, personnes âgées, victimes de torture,...) et des mineurs qu'ils soient ou non accompagnés, au mépris du respect de l'intérêt supérieur de l'enfant. La dernière version de ce texte permet la détention et l'expulsion forcée des mineurs isolés vers un pays tiers (autre que leur pays d'origine) où ils n'ont ni famille ni tuteur légal ; en outre, il n'est plus imposé aux Etats de fournir un titre de séjour aux personnes souffrant de maladies graves,
- une systématisation de l'interdiction du territoire de l'UE pendant cinq ans pour les personnes expulsées, soit l'exclusion et la criminalisation de ces personnes ;
- le renvoi des étrangers vers les pays par lesquels ils n'ont fait que transiter, sans qu'ils aient un lien avec ces pays.
Ce projet de directive doit maintenant être soumis au vote du Parlement européen le 18 juin prochain. Devant l'imminence de ce vote, il est important que la mobilisation se poursuive afin que ce projet de directive soit rejeté.

AGAINST THE OUTRAGEOUS DIRECTIVE:
THE MOBILIZATION HAS TO BE PURSUED
The proposal of the return Directive as it was recently amended and adopted by the representatives of Member States on May 22 is even more alarming that the amended text by the European Parliament last September against which we were mobilized.
While the points arousing our concern on the first project remain, there is a hardening of the text which includes:
- A detention of migrants up to 18 months, for the mere fact of having crossed borders and want to live in Europe;
- Detention and deportation of vulnerable people (pregnant women, the elderly people, victims of torture,...) and minors even unaccompanied, in defiance of respect for the best interests of the child. The latest version of the text allows the detention and forced expulsion of unaccompanied minors to a third country (other than their country of origin) where they have neither family nor legal tutor. Moreover, member States are not anymore obliged to give documents for stay to persons suffering from serious illness.
- A systematization of the re entry ban on EU territory for 5 years for the expelled migrants, which means the exclusion and the criminalization of these people;
- The removal of migrants to countries where they have only transit, but where they do not have a link with these countries.
The proposal of Directive must now be submitted to the vote of the European Parliament on the 18th of June 2008.
As this vote is imminent, it is important that the mobilization continues in order the return Directive is rejected.
