In 1993 the Van Passels had an absolute NR. 1 Smash Hit in S.E. ASIA with their song “DYING INSIDE TO HOLD YOU”, originally performed by USA artist Timmy THOMAS and later covered by various famous Asian artists, such as ALAN TAM.
September 1995: Belgian right society SABAM confirmed, after examination, that the largest part of the melody of the 1995 song “YOU ARE NOT ALONE”, that R. KELLY presented to Michael JACKSON, is identical to the 1993 Van Passel composition “IF WE CAN START ALL OVER”.
The Court of Appeal in Brussels confirmed, September 4th 2007, that the composition "YOU ARE NOT ALONE" has to be considered to be - an imitation - of "IF WE CAN START ALL OVER". The song (performed by Michael Jackson, Diana ROSS and many others) is original composed by Eddy VAN PASSEL & Danny VAN PASSEL. It’s an original Van Passel Brothers Music worldcopyright. Two Belgian composers, and not singer-songwriter R. Kelly, wrote the Michael Jackson hit "You Are Not Alone", according to a Belgian appeals court ruling today.
The 1995 hit, Jackson's last U.S. No. 1, was credited to R. Kelly, who also produced the song. But the appeals court backed a suit by Belgian composers Danny and Eddy van Passel that they were the original writers of the song.
The court said Jackson's song was a clear copy of "If We Can Start All Over," composed by the van Passel brothers two years earlier. It ruled that the brothers are now entitled to all writing royalties R. Kelly generated for the song.
The ruling ends a 12-year legal battle for the composers, who were backed by Belgian authors' rights group SABAM, whose own analysis of the song found that "the largest part of the melody is identical."
Although foreign rights associations are not directly legally bound by the Belgian ruling, SABAM intends to pass it on to rights groups around the world to recover the royalties.

Simon Cowell is urging fans of the show to buy the record to help sick children
All 12 remaining acts in the ITV talent show recorded the charity single, which will be sold to help sick children at the London hospital.
Viewers will see the singers perform the track for the first time during the results show on Sunday, November 15, when fans will be able to pre-order it.
The single will go on sale from Monday, November 16.
Jackson, who died in June, went to number one with the song in 1995.
The X Factor's finalists have topped the Irish singles chart this week with their charity release 'You Are Not Alone'.
